                                          ORDER

The present appeal, filed by Shri Sanjay Ravidas against Eastern Coalfields  Limited,  was   taken   up   for   hearing   on   21.08.2013   when   the   Respondents   were  present through Shri S. A. Yadav, Chief Manager (P). The Appellant was, however,  not present.

Facts of the case:

The Appellant through his RTI application dated 06.03.2012, filed with the  CPIO, Eastern Coalfields Limited, Rajmahal Area, Jharkhand,  wanted to know the  action   taken/daily   progress   report   on   his   representation   dated   26.01.2012,  addressed to Chief General Manager, Rajmahal Area, regarding non­payment of  CIC/SS/A/2012/002667 Page 1 of 5 2 compensation to him against some land acquired by the public authority. It was his  allegation that one Shri Makhan Ravidas had wrongfully taken the compensation  (against said land acquisition) from the pubic authority by forging his signature on  the affidavit.
3. Since the Appellant did not receive the information within the stipulated time  frame, he filed an appeal dated 09.04.2012 before the Appellate Authority.  
4. The Appellate Authority decided this appeal vide his order dated 30.05.2012  directing the CPIO to send the reply to the Appellant within 7 days after taking up  the matter with the concerned department.
5. The   Appellant,   however,   on   not   receiving   any   information   even   after   the  order of the Appellate Authority, filed the present appeal before the Commission.

Decision:

6. During   the   hearing,   the   Respondents   inform   the   Commission   that   the  Appellant   is   the   son   of   Shri   Makhan   Ravidas,   against   whom   he   has   leveled  allegation of fraudulently taking the compensation amount from the public authority. 

However, according to the Respondents the Appellant has been disputing this fact  and claiming himself to be the son of late Shri Lutan Ravidas (as also mentioned in  the   present   appeal   memo),   though   he   has   been   declared   as   the   son   of   Shri  Makhan Das by Court through a decree in suit No. 55/07. The Appellant now wants  to   have   share   on   the   compensation   amount   paid   to   Shri   Makhan   Ravidas.  According to the Respondents, they have sent a point­wise and factual information  to the Appellant in this regard by their letter dated 25.05.2012. 2

Having heard the submissions and perused the records, the Commission,  while   observing   that   the   Appellant   here   has   some   grievance   against   the   public  authority   on   the   subject   issue   which   is  civil  in   nature   and   thus   lies   beyond   the  purview of the RTI Act, holds that factual information has been communicated to  the Appellant by the CPIO's letter dated 25.05.2012. However, the Appellant has  not   been   provided   with   copies   of   documents   related   to   processing   of   his  representation in question. The CPIO at para 6 of his said reply dated 25.05.2012  had only asked the Appellant to collect the attested copies of relevant documents  from the concerned office which, according to the present appeal of the Appellant,  have not been collected by the Appellant.

8. In view of the above, the CPIO is hereby directed to furnish attested copies  of relevant documents to the Appellant relating to the processing of the Appellant's  representation in question.  

9. Appeal is disposed of with the above directions, which are to be complied  with within 2 weeks of receipt of this order.
