(5)Whoever without such permission as is required by sub-section (1), makes or causes to be made or in disobedience to the requirements of a notice given under sub-section (2), suffers to remain, any roof or wall of such material as aforesaid, shall, on conviction be punished with fine which may extend to [one thousand rupees] [These words were substituted for the words 'one hundred rupees' by Maharashtra 1 of 2011, Section 9(1), (w.e.f. 14-1-2011).], and in the case of a continuing offence with further fine which may extend to [two hundred and fifty rupees] [These words were substituted for the words 'twenty-five rupees' by Maharashtra 1 of 2011, Section 9(2), (w.e.f. 14-1-2011).] for every day after the first during which such offence continues.
