Section 28(1) in The Gujarat Industrial Relations Act, 1946
(1)Where there is no Representative Union is respect of any industry in any local area, the employees in each undertaking in the industry and in each occupation therein, in the prescribed manner, elect five persons from among themselves to represent them for the purposes of this Act:Provided that no such persons shall be elected for any occupation the number of employees in which does not exceed ten.
