01. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner as well as learned Addl. Government Advocate for the State of Odisha.

This Writ Petition which is in the nature of Public Interest Litigation has been filed by the petitioner Nuapada Durga Puja Committee, Nuapada with a prayer to demolish the illegal construction of the building over the case land i.e. Plot No.2482 (Gochara), Khata No.668 (Rakhita) of Mouza- Nuapada under Cuttack Sadar, P.S./Dist. Cuttack.

Learned counsel for the petitioner drew attention of // 2 // this Court to Annexure-4, which is a representation, highlighting the stand taken by the petitioner in the writ petition. It is stated that such representation has been made on 16.05.2022 and it has not yet been considered.

Learned counsel for the State submitted that the said representation shall be considered in accordance with law after giving an opportunity of hearing to the petitioner.

Considering the submissions made by the learned counsel for the respective parties and without going into the merits of the case, this writ petition is disposed of directing the opposite party no.4- Tahasildar, Cuttack Sadar to consider the representation of the petitioner under Annexure-4 within a period of four weeks from today after giving an opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner.

Urgent certified copy of this order be granted on proper application.

A free copy of this order be handed over to the learned counsel for the State.
