AB Court No.34
                                      W.P.L.R.T. 405 of 2014

Ujjwal Barter Pvt. Ltd. & Anr.
                                               Vs
State of West Bengal & Ors.

                                 Mr. Jaydip Kar,
                                 Mr. T. Chakraborty,
                                 Ms. Sohini Bhattacharya,
                                 Mr. K. Banerjee,
Mrs. R. Halder ...for the Petitioners.

Mr. L.K. Gupta, Ld. Addl. A.G.
Mr. Ayan Banerjee ... for the State.

When this case was called out, Mr. L. K.

Gupta, learned Senior Advocate appearing for the State,

prayed for some more indulgence so that he is in a

                   position to file the affidavit-in-opposition.

Mr. Jaydip Kar, learned Senior Counsel

appearing for the Petitioners, has no objection to a

further extension, but he makes a prayer that such

extension be the last one whereafter no further extension

                   be allowed.

We, accordingly, grant one last indulgence to

the State / Respondents to file their affidavit-in-

opposition by the 16th of February, 2015. Reply, if any, thereto may be filed by the 2nd of March, 2015.

After the aforementioned Order was dictated in Court, Mr. Jaydip Kar, learned Senior Counsel, submitted that he had never prayed for any interim order as was passed on 23.12.2014 directing the parties to maintain status quo in relation to the disputed properties till disposal of this writ petition and, therefore, he submits that the said order of status quo be vacated.

Mr. Kar further states that in fact, he has already filed an application for review being Review Petition No. 4 of 2015 before the Bench, which has passed the said Order. Since a review petition has already been filed and it is pending, we are not inclined to pass any Order disturbing or interfering with the Order already passed because we will wait for an appropriate order being passed on the review petition and then, the parties will have the liberty to mention for appropriate orders.

Let the matter appear under the appropriate heading for hearing in order of seniority on the 11th of March, 2015.
