Learned counsel for the petitioner wants to withdraw this writ petition as the appeal preferred against the order dated 15.9.2011 has been de decided by the Division Bench today itself. Therein, petitioner has been given liberty to take action against the order dated 18.11.2011 as provisions of law. The aforesaid is with the observation that interim order dated 15.9.2011 will not come in the way of the petitioner. He wants to challenge the order dated 18.11.2011 by filing a writ petition.

Learned counsel for respondents have not opposed the prayer made by learned counsel for petitioner.

In view of submissions made by the parties, so far as this writ petition is concerned, since petitioner wants to challenge the order dated 18.11.2011 as per the liberty given by the Division Bench, the final adjudication of the issue would be now in reference to the challenge to the order dated 18.11.2011 and aforesaid has been agreed by both the parties. Accordingly, with the liberty to the petitioner to take action as per direction given by the Division Bench, this writ petition is disposed of. However, order dated 15.9.2011 passed in this writ petition will not come in the way of the petitioner to challenge the order dated 18.11.2011. This disposes of the stay application also.
