Prayer in this petition is for issuance of directions to respondents No.1 & 2 to protect the life and liberty of the petitioner at the hands of respondents No.3 & 4, who want to implicate the petitioner in FIR No.09 dated 24.01.2018 under Sections 21/22/61/85 of NDPS Act, registered at Police Station Khilchian, District Amritsar Rural.

Reply by way of affidavit of Deputy Superintendent of Police, Sub Division Baba Bakala, Amritsar (Rural) filed in the Court today, is taken on record. In this report, it is stated that during the investigation, co-accused Komalpreet Singh @ Komal has disclosed that he got prepared an arm licence from the petitioner, who was then serving in the Indian Army, on the fake identity of Naik Komalpreet Singh and he has paid Rs.70,000/- to the petitioner for this illegal work. It is further stated that as per the reports received from the District Magistrate, Kishatwar, J&K (Annexures R-1/T and R-2), this fact was 1 of 2 ::: Downloaded on - 19-08-2018 09:59:00 ::: CRM-M-9516-2018 (O&M) -2- corroborated and thereafter, the petitioner was arrested on 12.05.2018 in the present FIR and Sections 420, 467, 468, 471 IPC were added.

Since the petitioner is in judicial custody, this petition is rendered as infructuous at this stage.

However, liberty is granted to the petitioner to raise all the pleas/defences during the course of trial.
