1The appellant has sought the following information:
1. Give date fixed for Convocation by the Sabha held in 2017 for the award of Ph.D. degree in the subject of Hindi.
2. Certified status of Ph.D. degree whether it has been awarded to the appellant in absentia or would be awarded on attending convocation.
3. Certified copy of order/circular/regulation vide which the Provisional certificate does not become invalid in case Ph.D. degree is not provided after 30/12/2016, as the same has become invalid after expiry of one year.
4. And other related information.
Grounds for Second Appeal The CPIO did not provide the desired information.
Submissions made by Appellant and Respondent during Hearing:
The appellant pressed for information in respect of point no. 5 of the RTI application. Moreover, he contested that information sent in respect of points no. 1 to 4 of the RTI application was unattested. The CPIO agreed to send the information in respect of point no. 5 of the RTI application. On a query by the Commission, he could not give any cogent reason for the failure to give certified copies of the documents in respect of points no. 1 to 4 and for not giving information in respect of point no. 5 of the RTI application.
Observations:
Based on a perusal of the record, it is noted that the CPIO came unprepared for the hearing. He needs to ensure that in future, due importance is given to the RTI applications and replies are provided with all seriousness by following the provisions of the RTI Act.
Decision:
The CPIO is issued a strict warning to be careful and refrain from providing incomplete replies which may attract penal action u/s 20(1) and (2) of the RTI Act. He is further directed to send the revised reply in respect of points no. 1 to 4 attaching the certified copies of the documents. In respect of point no. 5 of 2 File no.: CIC/MOHRD/A/2018/136870 the RTI application, the CPIO shall provide the certified copies of the information sought, within 10 days from the date of receipt of the order.
The appeal is disposed of accordingly.
