UPON hearing the counsel, the Court made the following
O R D E R
We deem it appropriate to issue notice to the Union of India, Signature Not Verified through Secretary, Ministry of Agriculture, with a direction to Digitally signed by NIRMALA NEGI Date: 2022.12.10 15:02:04 IST Reason: file an affidavit before this Court on whether the properties of 1 the Indian Veterinary Research Institute1, belong to and are owned by the Union of India or, they stand vested with Indian Council for Agricultural Research2, a society registered under the Societies Registration Act, 1860.
The affidavit will specifically indicate whether the actual transfer or vesting of the title of the property has or has not taken place in favour of the ICAR.
ICAR/IVRI and the Union of India will clarify whether any rent or license fee is being collected by IVRI, and whether the amount collected is credited to the account of the Central Government or is retained by the ICAR/IVRI.
The affidavit(s) will be filed by the Ministry of Agriculture and IVRI/ICAR within a period of four weeks from today or date of service, whichever is later.
Re-list in the month of February 2023.
