                 WRIT PETITION No. 21318 of 2021

O R D E R:

This Writ Petition is filed aggrieved by the inaction of the 3rd respondent - Director General of Police in disposing of the Appeal filed by the petitioner on 15.04.2021, challenging the order of removal dated 09.07.2018 in proceedings No. D.No. 5761 passed by the 2nd respondent.

The petitioner was appointed as Home Guard in 2001 and was attached to CAR Headquarters. A criminal case was registered against him for the offences punishable under Sections 498-A and 406 of the Indian Penal Code and Sections 4 and 6 of the Dowry Prohibition Act in Crime No. 135 of 2015 on the file of Women Police Station, South Zone, Hyderabad. Complainant therein is the wife of the petitioner. It appears, charge sheet was filed in the said case which was numbered as C.C. No. 405 of 2015 before the XV Additional Chief Metropolitan Magistrate Court, Hyderabad. On the ground of his involvement in the above criminal case, the 2nd respondent passed the order dated 09.07.2018 removing him from the rolls of City Home Guard Organization with immediate effect under the Code of discipline.

Learned Government Pleader for Home Sri M. V. Rama Rao submits that under the relevant Rules, a remedy of Appeal is provided even for Home Guards, who are appointed on honorarium basis.

In view of the submission of the learned Government Pleader, since the Appeal was already filed on 15.04.2021, it is just 2 and appropriate to direct the 3rd respondent to consider and dispose of the same expeditiously.

The Writ Petition is accordingly, disposed of directing the 3rd respondent to consider and dispose of the Appeal filed by the petitioner on 15.04.2021 within a period of six weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous Applications, if any shall automatically, stand dismissed.
