(3)After the expiration of one month form the date of a deposit being made under this section, the Collector shall pay therefrom to the applicant for distrain the amount due to him, unless in the mean while the person making a bona fide claim as the owner of the property distrained has instituted a suit against the applicant contesting the legality of the distraint and claiming compensation in respect of the same.
