ORAL ORDER
12 23-06-2022Heard learned counsel for respective parties.
The State-respondent, Principal Secretary, Education Department, Government of Bihar is hereby directed to appear in person along with the complete records on the next date of hearing. He is hereby directed to examine what are the steps taken by the State Government in respect of implementation of sub-section (2) of Section 23 of The Right of Children of Free and Compulsory Education Act, 2009. The affidavit must disclose the dates and events in respect of steps taken by the State Government insofar as implementation of the aforesaid provisions. Further, if there is any shortcomings in implementation of sub-section (2) of Section 23 of The Right of Children of Free and Compulsory Education Act, 2009 whether any communications have been made with the Central Government-Union of India, Human Resources Department, New Delhi so as to ascertain whether Union of India has taken Patna High Court CWJC No.16214 of 2019(12) dt.23-06-2022 142/142 any further steps in the matter in respect of giving effect to sub- section (2) of Section 23 of The Right of Children of Free and Compulsory Education Act, 2009.
Relist these matters on 07.07.2022.
Despite Union of India counsel was directed to serve a copy of the counter affidavit to each and every counsel for the petitioners as well as State Government it is stated to have not been served on some of the respective counsels. Before the next date of hearing, if the counter affidavit is not served on the respective counsels in that event such of those petitions stands allowed against the Respondent-Union of India.
Registry is hereby directed to de-link CWJC No. 12712 of 2021 from the bunch of the petitions in view of the fact that issue is entirely different from the bunch of the petitions.
