Heard on admission.
Appeal is admitted for hearing.
Issue notice to the respondent on payment of process fee within seven
working days failing which the interim order shall stand vacated automatically.
Counsel for the appellant is also heard on I.A.No.7134/2021 for stay. By placing reliance on the judgment of Delhi High Court in the case of Mrs.Nisha Rani Vs. Sh.Sohan Singh Nehra reported in (2017) 1 HCC (Del) 152 it is urged that the desertion of the appellant at best can fall within the ambit of "constructive desertion" and therefore, could not have been a reason for passing the decree of divorce.
Considering the aforesaid and subject to hearing the other side, till the next date of hearing, the impugned judgment dated 28.08.2021 shall remain stayed.
