Heard Mr. Vinod Nautiyal, Advocate for the applicants and Mr. B.M. Pingal, Brief Holder present for the State/respondent No.1.

A first information report has been filed by the respondent No.2 against the present applicants, which has been registered as Case Crime No.316 of 2014 for the offence under Sections 147/452/323/324/325/504 of IPC, at Police Station Jwalapur, District Haridwar. After investigation, police submitted charge sheet. Consequently, the learned Magistrate took cognizance in the matter and summons have been issued against the present applicants. Hence, the applicants have filed present application under Section 482 Cr.P.C. invoking the inherent powers of this Court.

Considering the nature of offence, at this stage, no interference is called for in the matter.

However, the applicants will be at liberty to move application for their bail before the court concerned, which may be considered, as far as possible, on the same day itself on its merit, and if for any reason, the bail is deferred, the learned court below may consider interim bail to the applicants. If for any reason, it is rejected, then the learned Magistrate shall forward the papers on the same day before the Sessions court which shall examine then the same day itself on the same terms referred to the learned Magistrate.

With the aforesaid observation, the application filed under Section 482 Cr.P.C. stands disposed.
