Instant petition has been filed by petitioners who are applicant for allotment of distributorship of LPG under Rajiv Gandhi LPG Vitrak (RGGLV) at village Duni (Tonk) pursuant to advertisement published in daily news paper Dainik Bhaskar dt.17/10/2009 (Ann.1).
Their grievance is in reference to allotment of LPG distributorship mentioned at S.No.60 by the BPC for Udaipuria (Chomu Distt. Jaipur) (open category). Counsel submits that as per Cl.4(b) of the advertisement published by the respondents for selection of LPG distributorship one has to be a resident of town/village of advertised location; however, respondent NO.4 is not a resident of the place where the allotment for distributorship is to be made which is impugned herein; and in the list published of eligible and qualified persons in a draw of selection, names of respondent-4 finds placed at S.No.9. Counsel further submits that a joint representation was made by the petitioners raising objections in regard to name of respondent-4 in the select list published by the respondents on 22.4.2010.
Without going into merits of the matter, the writ petition is disposed of with the direction to the petitioners to make a representation within 10 days from the date of receipt of certified copy of this order to the competent authority who may examine their representations and decide their objections obviously after holding opportunity to respondent-4, as well in accordance with law and pass a speaking order within one month thereafter, which may be communicated to each of petitioner who if still feels aggrieved, will be free to avail the remedy under law.
