The respondent assailed Rule 2.3 of the Telephone Allotment Rules, 1980 providing for grant of preferential treatment to the officers of the Post and Telegraphs vis-a-vis other officers of the Central and State Governments. The respondent was employed with the Indian Audit & Accounts Department and on retirement he applied for grant of telephone connection in the year 1988. He was registered under the Non-OYT (General Category) and made a request to the authorities to transfer his application to the S.S.category for expeditious grant of connection. There was, however, no response.

2. In terms of the impugned order dated 28.04.1994 it has been held that all the officers drawing the pay as prescribed for those from the Post and Telegraph Department are entitled to be included in the Special Category including the petitioner.

3. The appeal was admitted on 08.08.1994 refusing stay.

4. It is obvious from the aforesaid the appeal filed by Union of India has actually become infructuous and thus it appears with reason that none is present to press the appeal on behalf of the appellant. Dismissed.
