It is submitted that though the prayer for bail of this appellant was earlier rejected by this Court on 29/09/2004 but, now, he has remained in jail custody for about eight and half years and there is no chance of hearing of this appeal in near future; and that the prosecution has not been able to prove its case beyond all reasonable doubts.
On the other hand, counsel for the State opposed the prayer for bail.
In the facts and circumstances of the case, we are not inclined to reconsider the prayer for bail of this appellant. Accordingly, his prayer for bail is rejected again.
However, in view of the custody, let the appeal itself be listed for final hearing on 4th December 2012 within first five cases.
I.A. No. 1246 of 2012 stands disposed of.
