1.Heard learned advocate Mr.Devang R.Bhatt for learned advocate Mr.H.S.Munshaw for the applicant.

2.By this application, the applicant seeks condonation of delay of 20 days caused in filing the captioned Misc.Civil Application for restoration of the Special Civil Application No.19587 of 2017 and Restoration of Special Civil Application No.19587 of 2017.

Having regard to the submissions advanced by the learned advocate for the applicant and Page 1 of 2 Downloaded on : Mon Jan 08 20:39:36 IST 2024 NEUTRAL CITATION C/MCA/2236/2023 ORDER DATED: 05/01/2024 undefined more particularly considering the averments made in the memorandum of application, the Court is of the view that the delay caused in filing the Misc.Civil Application for Restoration Application has been sufficiently explained and Special Civil Application no.19587 of 2017 is to be restored.

4.The application, therefore, succeeds and is, accordingly, allowed. The delay is hereby condoned and the Special Civil Application No.19587 of 2017 is ordered to be restored to its original file.

5.This application is accordingly disposed of with cost of Rs. 500/- to be deposited in the Gujarat High Court Advocates Library.
