In the matter of : An application under Section 407 read with Section 482 of the Code of Criminal Procedure. Mr. Kazi Safiullah .....for the petitioners.

Mr. Safiullah, learned advocate for the petitioners pray for transfer of the proceedings from the court at Dakshin Dinajpur to any court within the jurisdiction of the District of North 24 Parganas.

Learned advocate for the petitioners also points that the next date is fixed on 4th January, 2021. According to the learned advocate as the petitioners are senior citizen and till date the investigation agency is praying for submitting supplementary charge-sheet, the learned court should not insist on the physical/personal appearance of the petitioners 2 on the said date and allow them to be represented by their learned advocate.

The learned court below is directed that the next date be fixed in the 1st week of February, 2021 for the said case for physical appearance of the petitioners and allow the petitioners to be represented through their lawyer on the date fixed in the month of January, 2021.

The revisional application is required to be heard out on merits.

The petitioners are directed to serve upon Mr. Sur, learned advocate who ordinarily appears for the State.

Mr. Sur, learned advocate for the State is directed to produce a report from the Investigating Officer of the case on the next date fixed for hearing.

Let the matter appear in the list under the heading "Contested Application" on 22nd January, 2021.
