ORAL ORDER
3 19-10-2016Heard learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends arrest in connection with Begusarai Town P. S. Case No. 249/2016 for offences alleged under Sections 420, 464, 468, 471 and 120B of the Indian Penal Code.
The prosecution case is that the informant, who is Police Insepctor cum Officer-In-Charge Town P.S., Begusarai recorded his self statement alleging therein that on 23.05.2016 at about 12.30 P.M. he received a secret information that owner of Monika Studio namely, Pankaj Singh established a shop in front of G.D. College where he prepares fake voter I.D., Adhar Card and Patna High Court Cr.Misc. No.37523 of 2016 (3) dt.19-10-2016 2/3 other Government papers.
It has been submitted by the learned counsel for the petitioner that he is innocent and he was not present in the shop at the time of raid by the police and further submits that his employee, Govind Kumar was there and he owns a small shop and used to prepare photo copy and do lamination of voter I.D. and Admit Card, Adhar Card and other documents. He further submits that the witnesses have not supported the case of the prosecution and it is only on the statement of his staff, Govind Kumar the petitioner has been implicated, who has already been granted the privilege of anticipatory bail by the learned Court below itself. It has further been submitted that the petitioner has no criminal history as is evident from para-3 of this application.
However, learned APP for the State Submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Patna High Court Cr.Misc. No.37523 of 2016 (3) dt.19-10-2016 3/3 Town P.S.Case No. 249 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
