In Re: An application for Bail under Section 483 of the Bharatiya Disposed of Nagarik Suraksha Sanhita, 2023, corresponding to Under Section 439 of the Code of Criminal Procedure, 1973 filed in connection with Chinsurah Police Station Case No.111 of 2018 dated 27.04.2018 under Sections 363/365 of the Indian Penal Code;

Rakesh Biswas Versus The State of West Bengal Mr. Suman Chakraborty.

...for the petitioner.

Mr. S.S. Imam Ms. Puja Goswami.

...for the State.

Affidavit-of-service filed by the petitioner be kept with the record.

Learned advocate for the State submits that the next date is fixed on 25th February, 2026. It has been portrayed before this Court that since 6th January, 2021 petitioner was evading the process of law.

Learned advocate for the petitioner submits that the petitioner is a migrant labour and has a child of two years.

Having regard to the fact that the offences for which charge-sheet has been submitted are under Sections 363/365 of the Indian Penal Code and the petitioner was evading the process of trial for the last four years, I direct that three months' time be granted to the State for recording the evidence of the victim. At this stage, the prayer for bail of the petitioner is rejected. 2 Learned advocate for the State will communicate this order to the learned public prosecutor so that the evidence of the victim is completed within the aforesaid time period.

Thus, CRM(M) 162 of 2026 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
