ORDER
Delivered by Hon'ble Mr. Devendra Chaudhary, A.M. Heard learned counsel for the parties on contempt petition.
2. This Tribunal had passed an order dated 31.08.2018 wherein the following directions were given to the respondents: -
"5. In view of the limited prayer made by the counsel for the applicant but without commencing anything on the merits of the case, the O.A. is disposed of with a direction to respondent No. 1/Ministry of Defence through Defence Audit Controller to consider 2 and decide the representation of the applicant in accordance with law by passing a reasoned and speaking order within a period of three months from the date of receipt of certified copy of this order and also look into the question that whether there are legal heirs of deceased Md. Ali Zubari or not and thereafter pass necessary orders as per law."
3. Learned counsel for the respondents submitted that in compliance of the Order dated 31.08.2018 passed by this Tribunal, the respondents have passed the Order dated 08.01.2019 (annexure CR-1) which is a detailed, reasoned and speaking order and the same is passed by the concerned competent authority. However, this contention of respondents' counsel has been controverted by the applicant's counsel. He has submitted that the compliance is still not made even if by the order dated 08.01.2019.
4. After perusal of the order dated 08.01.2019, passed by the respondents, in compliance of the Order of this Tribunal, we are of the view that the Order dated 31.08.2018, extracted above, of this Tribunal has substantially been compiled by the respondents and there is no willful disobedience of the Order passed by this Tribunal. Hence, notices issued to the respondents are hereby discharged and the Contempt Petition stands dismissed.
