44. Exclusion of certain interested persons from guardianship.
- No person who would be the next legal heir of a ward or would otherwise be immediately interested in outliving a ward, shall be appointed to be his guardian ;but nothing in this section shall apply to the mother of a ward or to a testamentary guardian.
