1. The above matters were on yesterday's board. However, when the same were called out, none appeared for the Petitioners. In view thereof, the order that was passed and uploaded at 7.00 p.m. on 2nd February, 2021 is reproduced hereunder :
"1. None appear for the (i) Petitioners, (ii) Respondent No.2 - the Chief Officer of Mumbai Building Repairs and Reconstruction Board and (iii) Respondent No.3 - Mr. Vilas Chandrakant Gaonkar - developer.
2. Stand over to 3rd February, 2021 when the Petitioners as well as Respondent Nos.2 and 3 are directed to remain present by themselves and/or through their Advocates."
2. Today the above Writ Petitions are called out at 3.38 p.m. However, once again none appear for the Petitioners and/or for Respondent No.3 - developer. In view thereof, as a last chance and only by way of indulgence, the matters are once again adjourned to 5th February, 2021. It is made clear that if the Petitioners fail to remain present by themselves and/or through their Advocate/s on the adjourned date, ssp 3/4 28 wp 3683 of 2018.doc the Court will be constrained to dismiss the above Writ Petitions. It is also made clear that if the Respondent No.3 - developer fails to remain present on the adjourned date, the Court shall proceed to hear the parties and pass appropriate orders in the matter. Stand over to 5th February, 2021, high on board.
