1. For the reasons as stated in the application, delay in filing the written statement is condoned. Written statement to the amended plaint is taken on record. I.A. is disposed of.

CS (OS) 2940/2014 & CS (OS) 3105/2014

2. Certain proposals have been exchanged between the parties. In order to further explore settlement, parties agree that the property bearing No.K- 58, Jung Pura Extension, New Delhi be valued by an independent valuer to arrive at the value of one floor in the said property. Accordingly, Mr. S. C. Sharma, (M:9811452119) is appointed as the independent valuer to give valuation for one floor in the property bearing No.K-58, Jangpura Extension, New Delhi. The Valuer may consider the location, extent of construction, age of construction, land value as also circle rate and market rate while submitting the valuation. Fee of the Valuer is fixed as Rs. 20,000/- to be shared equally by the Plaintiff and the Defendants 2-3. Let the report be filed within four weeks. The valuation report shall be without prejudice to the contentions of the parties.

3. List on 11th March, 2019. Affidavits of admission/denial be also filed by the respective parties before the next date.
