Delay condoned.

We see no sustainable ground to interfere with the impugned order as we are of the view that any repercussion that the Union of India might have to bear towards payment of enhance pension at all levels will be the subject matter before the High Court either by way of a modification application or at the contempt level provided Union of India is able to justify non-revision of pension at all levels.

However, learned senior counsel submitted that the Secretary, Ministry of Labour and Employment has been directed to appear before the High Court in the contempt petition. We leave it open to the counsel to request the High Court to allow the presence of a representative on behalf of the Secretary instead of the Secretary himself remaining present before the High Court and it is for the High Court to consider whether his presence is absolutely essential or his representative may be sufficient and competent to represent the Secretary.

Subject to this observation, the special leave petition is dismissed.
