The Appellant filed an RTI application dated 09.11.2022 seeking the following information:Page 1 of 7
विषयः सूचना का अधिकार अधिननयम (RTI) 2005 के अन्तर्गत प्लॉट नं 141, 80 र्ज सनलाईट कालोनी-2, नई दिल्ली-110014 में स्थित उक्त विभार् के अिीनथि, इस प्लॉट के संबंि में ननम्नललखित जानकारी हे तु ।
1. ितगमान में उक्त विभार् के अिीनथि प्लॉट नं 141, 80 र्ज सनलाईट कालोनी-2, नई दिल्ली-110014 में स्थित इस प्लॉट के रिरिाि के सरकारी स्जम्मेिार अधिकाररयों के नाम, पि, कायागलय पता एिं सम्पकग सूत्र सदहत सूची िें एिं यह भी बताएं कक इस प्लॉट पर अर्र कोई भी र्ैरकानूनी तरीके से अपना माललकाना हक जमाता है तो इस विषय में संबंधित सरकारी ररपोटग का नाम एिं सम्पकगसूत्र सदहत जानकारी िें ।
2. ितगमान में यह प्लॉट उक्त विभार् ने रिरिाि के ललए ककसी अन्य विभार् को थिानान्तरण कर दिया है तो उस विभार् के भी सरकारी अधिकाररयों के नाम, पि, कायागलय पता एिं सम्पकग सूत्र सदहत सूची िें एिं उक्त विभार् द्िारा ककये र्ए थिानान्तरण पत्र की छायाप्रनत िें ।
3. दिनांक 18.07.2022 की आर.टी.आई. के तहत उक्त विभार् द्िारा िी र्ई प्राप्त जानकारी के अनुसार यह उक्त प्लॉट 1976 में विभार् द्िारा अलॉटमें ट बताया र्या है। इस प्लॉट के अलॉटी ने उक्त प्लॉट का रूपया विभार् के ननयमानुसार ककस बैंक में जमा कराया िा? बैंक में रुपया जमा कराने के बाि जो अलॉटी को बैंक द्िारा रसीि िी र्ई िी स्जसको अलॉटी ने विभार् में जमा कराया है , उस रसीि की भी छायाप्रनत िें ।
4. 1976 में उक्त प्लॉट पर अलॉटमेंट के बाि प्लॉट को सील करने के आिे श ककस दिनांक को हुए और ककस कोटग द्िारा आिे श दिया र्या िा? सील करने का कारण भी बताएं और उक्त प्लॉट को सील करने िाले सरकारी अधिकाररयों के नाम, पि, कायागलय पता एिं सम्पकग सूत्र सदहत सूची िें स्जनकी मौजूिर्ी में इस प्लॉट को सील ककया र्या िा। कोटग के उन सभी िथतािेजों की छायाप्रनत िें जो सील करने के ललए विभार् में जमा करिाए र्ये िे।
5. दिनांक 18.07.2022 को लर्ी आर.टी.आई की तीसरी प्रिम अपील दिनांक 04.11.2022 को स्जसकी सुनिाई विभार् में शाम 4.00 बजे हुई। सुनिाई के िौरान उक्त प्लॉट से संबंधित श्रीमान कायगपालक अलभयंता जी भी उपस्थित हुए और उन्होंने कुछ िथतािेज िरू से ही हमें दििाकर बताया कक यह प्लॉट सिगप्रिम 1976 में ककसी आयाग र्ौतम के नाम से अलॉटमेंट हुआ िा, मर्र ये िथतािेज प्रािी को नहीं दिये र्ये, उन सभी िथतािेजों की छायाप्रनत िें जो कायागपालक अलभयंता जी के हाि में िे और यह भी बताएं कक जब श्रीमान डायरे क्टर महोिय जी के कायागलय (हे ड क्िाटग र) Page 2 of 7 में कोई भी िथतािेज मौजूि ही नहीं है तो इस प्लॉट से संबंधित िथतािेज श्रीमान कायगपालक अलभयंता जी के पास ककस विभार् द्िारा उपलब्ि करोय र्ये?
6. उक्त प्लॉट का 1976 के प्रिम अलॉटी ने इस अपने प्लॉट पर आज तक कब्जा नहीं ककया। इसका भी कारण बताएं।
7. उक्त प्लॉट को 1976 के अलॉटी ने ककसी अन्य व्यस्क्त को बेच दिया है स्जसकी जानकारी विभार् को नहीं िी र्ई है ? अर्र हां तो उन सभी िथतािेजों की छायाप्रनत िें , जो क्रेता ने अपने िरीिने के सभी िथतािेज प्लॉट से संबंधित विभार् में जमा कराये हैं।
8. ितगमान में उक्त प्लॉट पर ककस व्यस्क्त ने अपना माललकाना हक दििाकर कब्जा लेने के ललए स्जस दिनांक को भी माननीय कोटग में केस डालकर इसमें पूिग लर्ी सील को िुलिाने के ललए आिे श करिा कर उक्त विभार् में जमा करिाये हैं उन सभी सील िुलिाने के फाइनल आिे शों के िथतािेजों की छायाप्रनत िें और यह भी बताएं कक विभार् के ककन-ककन अधिकाररयों की मौजूिर्ी में यह सील िुलिाया र्या? और उस अनुमनत पत्र की भी छायाप्रनत िें जो विभार् ने इस प्लॉट की साफ सफाई के ललए उस केस िारक को सौंपी है।
9. ितगमान में केस िारक ने अपनेआप को उक्त प्लॉट का माललक बनने के जो भी िथतािेज विभार् में जमा करिाये हैं उन सभी िथतािेजों की छायाप्रनत िें , जो उक्त प्लॉट का माललक बनने का प्रमाण िशागता है।
10. ितगमान में सनलाईट कालोनी-2, नई दिल्ली-110014 के क्षेत्र में और ऐसे ककतने 80 र्ज के प्लॉट िाली हैं स्जनका रिरिाि उक्त विभार् कर रहा है ? सभी प्लॉटों के नंबर सदहत सूची िें ।
The CPIO furnished a point-wise reply to the Appellant on 17.11.2022 stating as under:
Point No. 1 & 2: सूधचत ककया जाता है कक मांर्ी र्ई सूचना L&L Branch में उपलब्ि नहीं है। इसललए, जानकारी उपलब्ि नहीं होने के कारण प्रिान नहीं की जा सकती है। सूचना का अधिकार अधिननयम, 2005 पहले से उपलब्ि सूचना की आपूनतग का प्राििान करता है। अधिननयम में ककसी भी मुद्िे /मामले पर राय व्यक्त करने का कोई प्राििान नहीं है , इसललए जानकारी की आपूनतग नहीं की जा सकती क्योंकक यह Page 3 of 7 आरटीआई अधिननयम, 2005 की िारा 2 (एफ) के तहत पररभावषत "सूचना" की श्रेणी में किर नहीं होता है।

Being dissatisfied, the appellant filed a First Appeal dated 28.11.2022. The FAA vide its order dated 04.01.2023, held as under:
"In reference to your appeal under RTI Act, 2005 it is stated that modified reply to your application dated 9/11/2022 as received from the PIO is enclosed herewith. The applicant has telephonically requested that he will not be able to come on date fixed for due 12/1/2023. As requested on telephone by the applicant date fixed stands cancelled. Your appeal stands disposed off."
Letter enclosed reproduced as under:
"1. The information sought is ambiguous and unable to understand. Hence information sought cannot be provided. It is not clear if the applicant is seeking information pertaining to DUSIB or any other Page 4 of 7 department. It is pertinent to mention that the maintenance of the services of the area of plot No. 141, Sunlight JJ Colony, New Delhi have already been transferred to MCD long back in the year 1988. The maintenance of the services and building activities etc. are being looked after by the concerned officers of MCD posted there from time to time under the supervision of the Dy. Commissioner (South), MCD.
2. Same as above.
3. The information sought by the applicant is of the year 1976 which is very old and is not available with this office at this time. Moreover, the original allotment file of the concerned property is missing since very long. Hence information sought cannot be provided.
4. The information sought by the applicant pertains to other person's allotted property and it is a third-party information which has no relation with the applicant who is a stranger to the property. The same is exempted under section 8 (j) of the RTI Act and cannot be provided to the applicant. Moreover, the original allotment file of the concerned property is missing since very long. It is pertinent to mention that the aforesaid property was not sealed due to any order of the court. Property was sealed by the concerned officials of the Demolition Section of Slum & JJ Department on 17/4/2000 due to unauthorised construction.
So far as court case is concerned, the court of Ms. Anu Agrawal, Civil Judge, Saket courts vide order dated 1/6/2011 in Civil Suit No. 263/2010 "Smt. Aruna Kumari Gautam Vs. MCD (Slum & JJ)" had ordered to deseal the aforesaid property in favour of plaintiff. The court had not ordered to seal the property.
5. The information sought is ambiguous and unable to understand. No such incidence of showing any document to the applicant in personal hearing under RTI Act as stated in this para had happened. However, the information sought is also exempted under section 8 (j) of the RTI Act and cannot be provided to the applicant.
6. The information sought is ambiguous and unable to understand. Hence information sought cannot be provided.
7. The information sought by the applicant pertain to private party. Hence information sought cannot be provided by his office.Page 5 of 7
8. The information sought is ambiguous and unable to understand. No such incidence as stated in this para had happened. However, the information sought is also exempted under section 8 (j) of the RTI Act and cannot be provided to the applicant.

It is pertinent to mention that it is an old allotment matter which was made in the year 1976 and at present no new allotment is being made to anybody at Sunlight JJ Colony, New Delhi. Moreover, the original allotment file of the concerned property is missing since very long.
10. The information sought is ambiguous and unable to understand. No vacant plot is being looked after by this office at Sunlight JJ Colony, New Delhi. At present there is no scheme/policy for allotment of 80 sq. meters plot at Sunlight JJ Colony, New Delhi. It is pertinent to mention that the maintenance of the services of the area of Sunlight JJ Colony, New Delhi have already been transferred to MCD long back in the year 1988."
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

The following were present:-
Appellant: Present in person.
Respondent: Shri Belaram Singh, Dy. Director/ PIO along with Shri B. C. Arya, HC present in person.
Appellant expressed his dissatisfaction stating that complete information as requested has not been provided to him till date. Later, he restricted his arguments that Respondent should informed in writing whether Plot No. 141, Sunshine, JJ Colony, New Delhi has been assigned to some allottee or not.Page 6 of 7
Respondent submitted that a point-wise reply along with relevant available information has already been provided to the Appellant. He further agreed to abide by the directions of the Commission.
Decision:
The Commission, after adverting to the facts and circumstances of the case, hearing both the parties and considering the limited prayer of the Appellant during the hearing, directs the Respondent to inform the Appellant in writing, within two weeks from the date of receipt of this order, whether the subject matter plot has been allotted to any allottee or not, preferably in the form of yes or no. In doing so, the Respondent is at liberty to invoke Section 5(4) of the RTI Act to access the information from the concerned officer.
The First Appellate Authority to ensure compliance of this order.
The appeal is disposed of accordingly.
