In the present case, the petitioner has claimed that the service which he had rendered with HSMITC from 01.12.1981 to 04.10.2011 be counted as a qualifying service for the purpose of grant of pensionary benefits.
Learned counsel for the petitioner states that for this very purpose, the petitioner has served the respondents with a legal notice dated 03.08.2018 (Annexure P-5) and the petitioner will be satisfied in case a time bound direction is given to the respondents to decide his legal notice by passing a speaking order.
Learned counsel for the respondents has no objection for the grant of above said prayer.
Keeping in view the aforesaid facts, the present writ petition is disposed of with a direction to respondents No. 2 and 3 to look into the grievances unfolded by the petitioner in his legal notice dated 03.08.2018 1 of 2 ::: Downloaded on - 07-01-2019 01:40:56 ::: CWP No. 26903 of 2018 2 (Annexure P-5) and pass a speaking order in terms of judgment passed by this Court in CWP No. 24340 of 2016 captioned as Om Parkash and another Vs. State of Haryana and others, decided on March 24, 2017 as well as retiral benefits within a period of three months from the date of receipt of certified copy of this order.
However, it is made clear that this Court expresses no opinion on the merits of the case and the claim made by the petitioner either in the present writ petition or in the legal notice.
