What was required to be furnished as per the order was the list of staff members, doctors and others who were working in the hospital from March 2020 till the death of the patient. Perusal of the compliance report does not make it clear that who were on duty during the said period. Hence, learned Senior Additional Advocate General is directed to furnish complete and relevant particulars on or before the next date of hearing.

r to As per direction issued on 18th March, 2021, learned Senior Additional Advocate General was directed to place on record Magisterial inquiry report and the record pertaining to the same. In compliance to the said order, he has placed on record the report, conclusion part whereof reveals several instances of irregularities found, which are as under:
"iii) Act of commission or omission on part of any public servant that contributed to the incident.
Looking at the facts that the deceased did not get medicines for blood pressure and headache in time and also she was not taking the meals, it shows that there has been slackness on part of the staff on duty and Hospital. Visits of the doctors were not regular. Proper supervision of patients was lacking.
Only one Doctor, two Staff Nurses, one Class-IV and two Sanitary Workers were deployed in one shift and the number of patients was large.

relating to the incident which the enquiry officer deems fit to report.
I have also talked to may COVID patients telephonically on 27.09.2020 and 29.09.2020, who were discharged after treatment or are still undergoing treatment in DDU and a few of them are/were in the same ward where the deceased was admitted. The details including the phone numbers were obtained from the Medical Superintendent, DDU. These people shared their experience but did not want their identity to the disclosed. Following observations are made on the basis of the feedback taken from them:-
1) The doctors do not visit the ward generally.
They used to come on cal to the ward or would talk telepathically. It was also told that after the suicide incident, the doctors have started coming to the ward and even interacting with the patients.
2) Some persons said that the status of cleanliness is satisfactory while the others told that toilets are not clean.
3) Quality of food was said to be satisfactory.
After the suicide incident, the plates of better quality are being used. Aqua guard are installed for water ::: Downloaded on - 23/04/2021 20:21:10 :::HCHP inside the ward but many times hot water is not .
available.
4) Some persons narrated that the sisters would only come upto the door of the ward and send the oxymeter and BP apparatus inside and ask the patients to check the oxygen level and BP and tell them the reading thereof.
5) r Oxygen Central Plant is not in order most of the times and the patients have to carry the oxygen cylinders from the balcony to the ward. It has been mentioned by one of the doctors also in the statement that the Oxygen Central Plant is not functional many times. It was also learnt that post suicide incident, the cylinders are being brought by the staff.
6) Some of them told that when call is made for food from outside, it is not audible to those who are staying in the rooms located away from the door/entrance of the ward.
7) The condition of those elderly people is bad who are not able to sit/stand at their own. They face difficulty in going to toilet.
8) One patient who has been discharged after the deceased committed suicide, shared that on the evening of 22-09-2020, she had met the deceased ::: Downloaded on - 23/04/2021 20:21:10 :::HCHP who was walking with difficulty and she wanted to go .

9) Some of them told that they received the items sent by their families and attendants in time and there were others who said they did not receive the sent items or got after some delay.
10) Two of the patients told that sometimes the deceased would lie down on the floor. She also used to ask for cold/chilled water."
The report further alleges negligence and inaction on the part of many staff members of the Hospital. Item No.IV(2) discussed about the status of cleanliness satisfactory while the other told that toilets are not clean; Item No.IV(4) discussed about the sisters who came upto the door of the ward and send the oxymeter and BP apparatus inside and ask the patients to check the oxygen level and BP and tell them the reading thereof; and Item No.IV(7) discussed about bad conditions of elderly people who are not able to sit/stand at their own. They face difficulty in going to toilet.
After going through the entire instances, it is found that several persons, who are responsible for the negligence, might be the reasons for the patient to end her life by committing suicide. Thus, there is negligence on the part of the staff of the hospital. are/were working in the hospital from March, 2020 till the death of the patient. The respondent-State is also directed to make submissions as to whether any inquiry has been initiated against the persons/staff responsible for the death of the patient.
