Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Gomia P.S. Case No. 186 of 2013 corresponding to G.R. No. 1358 of 2013, for the alleged offences under Sections 409, 420 and 447 of the Indian Penal Code.

There is allegation against the petitioner, being the President of Chipri PACS to have misappropriated the stock of paddy as also not to have made the payment to the person, from whom, the paddy was procured and to have made payment to one other person illegally.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and the petitioner has cleared all the dues against him, for which documents have been brought on record. Learned counsel has accordingly, prayed for anticipatory bail.

Learned counsel for the State has opposed the prayer. The impugned order supports the contention of learned counsel for the petitioner.

In the facts of this case, I am inclined to grant anticipatory bail to the petitioner, Kameshwar Singh. Accordingly, it is directed that in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of Sri Y.C. Verma, learned Judicial Magistrate, 1st class, Bermo at Tenughat, or his successor, in connection with Gomia P.S. Case No. 186 of 2013 corresponding to G.R. No. 1358 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
