UPON hearing the counsel the Court made the following
O R D E R
The petitioners in these special leave petitions questioned the correctness of the preliminary Notification issued under Section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 Signature Not Verified (hereinafter referred to as “the Act”). The same Notification was Digitally signed by Vinod Kumar Date: 2015.12.03 17:55:14 IST Reason: questioned by filing writ petitions before the High Court. The High Court of Orissa at Cuttak disposed of the writ petitions with 2 liberty to the petitioners to challenge the final Notification that may be issued under the provisions of the Act.
It is brought to our notice by the learned counsel appearing on behalf of the petitioners that after issuance of the Notification in these proceedings the respondents without following the due process of law started demolishing the structure on the property in question.
Regard being had to the liberty given by the High Court in the writ proceedings, the demolition is stayed for a period of three weeks from today to facilitate the petitioners herein to approach the High Court to challenge the action of the respondents after issuance of the final Notification with regard to the demolition of the property in question without following the due process of law.
Needless to mention that the High Court shall consider the matter on its own merits in accordance with law.
With the aforesaid observations and directions, the special leave petitions as also the application for directions stand disposed of.
