Section 26(4) in Coal Mines (Nationalisation) Act, 1973
(4)In relation to a coal mine the operations of which were, immediately before the taking over of the management of such coal mine under the Coal Mines (Taking Over of Management) Act, 1973, (15 of 1973) under the control of a managing contractor, the amount specified in the fifth column of the Schedule against such coal mine shall be apportioned between the owner of the coal mine and such managing contractor in such proportions as may be agreed upon by or between the owner and such managing contractor, and in the event of there being no such agreement, in such proportions as may be determined by the court on a reference made to it by the Commissioner.
