(3)a person who has been held to have committed an act which would but for the unsoundness of mind of the doer, have constituted an offence, but who has been acquitted on the ground that he was of unsound mind when the act was committed, and is detained under section 334 of the Code of Criminal Procedure 1973, pending the orders and during the pleasure of the Government; and
