This appeal is filed under Section 100 of the Code of
Civil Procedure, against the Judgment and Decree dated
15.12.2005 passed in R.A.No.27/2004 on the file of the Civil
Judge (Sr.Dn.) and Assistant Sessions Judge, Bailhongal,
dismissing the appeal filed against the Judgment and Decree
dated 28.05.2004 passed in O.S.No.32/1994 on the file of
Additional Civil Judge (Jr.Dn.), Bailhongal.
This appeal coming on for Orders this day, the Court
delivered the following:
JUDGMENT
Learned counsel for appellant submits that he has returned the appeal papers to appellant, but no documents in the form of acknowledgment is filed to demonstrate such return of file and no formal memo is filed seeking permission to retire and he is also not in a position to go on with the matter on the pretext that he does not have file with him. Said prayer is rejected. Consequently the appeal is dismissed for non prosecution.
