1. Challenge in the present writ petition is to the order dated 23.09.2022 whereby an agreement dated 14.03.2022 executed between the petitioner and respondent-State for holding and managing the cattle fair in the State of Haryana for a period of 02 years has been terminated without granting any opportunity of hearing to the petitioner in an illegally and arbitrary manner.

Learned counsel appearing on behalf of the respondents contend that the period for which the contract had been originally granted has already come to an end and that the exercise is academic in relation to legality of termination of the agreement and would involve disputed 1 of 2 ::: Downloaded on - 25-07-2024 10:49:46 ::: Neutral Citation No:=2024:PHHC:091894 2 245 CWP-22569-2022 (O&M) questions of fact in relation to determination of compensation, if any, in the event of wrongful termination of the agreement.
3. Taking into consideration the changed circumstances and noticing that the original period of agreement has already come to an end and that the duration was not extended and the right of the petitioner, if any, shall only be with respect to compensation for the exact loss which would give rise to the disputed questions of fact that cannot be gone into by this Court.
4. The present petition is disposed of at this stage with liberty to the petitioner to take recourse to his alternate remedies to challenge the impugned order and to raise all such pleas including the plea of compensation, if so advised.
5. Needless to mention that in the event of the petitioner approaching any competent Court for challenging the impugned order and for compensation, the period during which the present writ petition remained pending before this Court shall be taken into consideration.
6. All other civil misc. applications, if any, stand disposed of.
