Information sought:
The Appellant filed an RTI application dated 13-12-2022 seeking the following information and the CPIO furnished a point-wise reply to the Appellant on 11- 01-2023 stating as under:

2 class 3 वलकग भर्ी होर्े समय िोनों आपके द्वारा मांगी गयी कमगचाररयों का प्रॉफ्टटी एवं बैंक में जमा ब्यौरा जानकारी कार्मगक ववभाग एवं उस समय का घर का पर्ा रे ल ववभाग में से संबंधिर् हे । जमा करवा गया होगा पूणग जानकारी सत्यावपर् कापी सदहर् जानकारी िे 3 उक्र् वर्गमान में िोनों कमगचाररयों का पर्ा बैंक आपके द्वारा मांगी गयी एकाउं ट बैंक का नाम और घर का पर्ा क्या हे जानकारी कार्मगक ववभाग सत्यावपर् कापी सदहर् जानकारी िे से संबंधिर् हे ।
4 कोववड 19 पर रे लवे स्टे शन आनंि ववहार से आपका प्रश्न स्पष्ट नहीं उक्र् िोनों कमगचाररयों को दिल्ली पासगल घर में है । कृप्या स्पष्ट उलेख भेजा गया था र्ो स्टाफ की कमी के बावजूि करें र्ाकक सही जानकारी िोनों कमगचाररयों को ककस अधिकारी एव मख् ु य उपलब्ि करायी जा सके।
पासगल सुपरवाइजर सामान्द्य ने पक्के र्ौर पर रात्री नौकरी पर लगाए रखा र्था जब कोववड स्पेशल ट्रे न नहीं आर्ी थी र्ब इन कमगचाररयों को कहा पर नौकरी (कायग) करने पर लगाया जार्ा था जबकक स्टे शन पर पासगल बाबु एक नहीं बहुर् ज्यािा प्लेटफामग पर कायग करने को मजबूर रहे CPS (T) जो भी रहे उनसे र्लखखर् Page 2 of 7 रूप में सत्यावपर् कापी सदहर् जानकारी िे 5 स्टे शन पर कायग करने के िौरान श्री राजीव आपके द्वारा मांगी गयी अलमाखण 42 दिन सस्पेंड वाहे क्या क्या जानकारी सर्कगर्ा ववजजलेंस ववभाग में श्री राजीव अलमाखण को ववभाग से संबंधिर् हे । दिल्ली हे ड काटग र बडोिा हाउस में जवाब िे ने के र्लए बल ु ाया वो कौन सा घोटाला सामने आया था जजसमे ववजजलेंस ने अपने कायागलय में बुला कर जवाब र्लब ककया पण ू ग अधिकाररयों द्वारा PP Notification की र्था उस घोटाले की सत्यावपर् कापी सदहर् जानकारी िे 6 उक्र् घोटाले में मुख्य पासगल सुपरवाइजर RPF आपके द्वारा मांगी गयी Staff GRP Staff जजन सभी कमगचाररयों कक जानकारी सर्कगर्ा जवाबिे दह होर्ी हे सब को बुलाया गया था और ववभाग से संबंधिर् हे ।
र्लखखर् रूप में जवाब र्लया गया था ज क्या इन सब कमगचाररयों को ववजजलेंस ववभाग ने हे ड काटग र बडोिा हाउस में बुला कर पूछ र्ाछ एव र्लखखर् में बयान िजग ककए थे सत्यावपर् कापी सदहर् जानकारी िे 7 ववजजलेंस कमगचाररयों ने उक्र् ब्यान र्लखखर् आपके द्वारा मांगी गयी रूप में िजग ककए थे उनकी पूणग ररपोटग र्था जानकारी सर्कगर्ा क्या रे ल अधिकाररयों को ननवेिन ककया गया ववभाग से संबंधिर् हे । था कक क्या क्रयवाही करने की प्राथगना की गई थी उक्र् ववजजलेंस कमगचाररयों के नाम, मुलपि सदहर् सत्यावपर् कापी जानकारी हे र्ु िे 8 42 दिन बाि क्या बबना SF-1/SF11/SF5/जारी आपके द्वारा मांगी गयी ककए नौकरी पर वावपस दिल्ली पासगल कायागलय जानकारी सर्कगर्ा दिल्ली स्टे प्शन पर भेज दिया गया ववभाग से संबंधिर् हे ।
आपका प्रश्न स्पष्ट नहीं 8A जबकक जो स्टाफ अन्द्य स्टे शन से दिल्ली है । कृप्या स्पष्ट उलेख से वावपस उनके मल ू स्टे शन भेज दिया गया था करें र्ाकक सही जानकारी र्ब श्री राजीव अलमानी श्री कमलजीर् र्संह उपलब्ि करायी जा सके।

"Your above cited application received through Nodal Officer-cum Sr. DMM/Store vide their letter no. NRDLD/R/X/22/00168 dated 28.12.2022, information asked by you pertains to third party information. Moreover, RTI cannot be treated as information under RTI ACT in pursuance of Hon'ble High Court Bombay Bench at Goa, directions passed in WP No- 419/2007dated-03/04/2008 which is circulated by DOPT vide OM No- 1/7/2009-IR dated- 01/06/2009 being information sought in within fold answer to question Why. Which, When, What and Whereas asking the reason, hence it cannot properly classified as information."

Latte Enchanted Page 4 of 7 उपरोक्र् ववषय एवं सन्द्िभग में दिए गए पत्रों के अनस ु ार जानकारी उपलब्ि कराने के र्लए प्रश्न 1. क्या ननिे शक स्टे शन द्वारा मेरे Clint श्री मुकेश कुमार बग्गा की कोववड स्पेशल छुट्टी क्यो मंजूर नहीं की गई प्रनर्र्लवप सग्लन कुल िो प्रश्न 2 क्या ननिे शक स्टे शन रे लवे बोडग, महाप्रबंिक उर्र रे लवे र्था अपर मंडल रे ल प्रबंिक के र्लखखर् आिे श की अवेहलना कर सकर्े हैं अगर कर सकर्े हैं र्ो रे लवे बोडग है ड क्वाटग र मंडल रे ल प्रबंिक कायागलय द्वारा जारी र्लखखर् आिे श की काफी सग्लन करे ? या वह र्लखखर् रूप में यह बर्ाए की. ननिे शक स्टे शन द्वारा क्या और ककस कारण से मेरे मुवजक्कल की छुट्टी स्पेशल कोववड मंजरू नहीं की गई प्रश्न 3 क्या ननिे शक स्टे शन मेरे मव ु जक्कल श्री मक ु े श कुमार बग्गा की र्लखखर् प्राथगना को स्वंय ना मंजूर के र्लए कोई अधिकार नहीं थे र्ो क्या नही ननवेिन पत्र को उच्च अधिकाररयों के पास नहीं भेजा गया प्रश्न 4 दिल्ली मंडल के. जजर्ने कमगचाररयों को LAP HAP. छुट्टी मंजूर की गई र्था जजन कमगचाररयों की कोववड स्पेशल छुट्टी को मंजूर कर र्लया गया था सभी कमगचाररयों की र्लखखर् रूप से िी गई ननवेिन पत्र की काफी सग्लन कर जवाब सत्यावपर् कापी सदहर् जानकारी िे I Having not received any response from the CPIO, the appellant filed a First Appeal dated 19-01-2023. The FAA order is not on record.
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeals.

Respondent: Ms. Leena Anand, APO/ Legal and CPIO accompanied with Shri Satish Kumar Jindal, AVO-Vig./CPIO, Shri Rohtash Kumar, COS, DRM Office; Shri Anuj Kumar, RTI/OS/Vig., Baroda House, New Delhi present in person.
Dr. Kanishka, DCM/FS-cum- CPIO and Ms. Nisha Chaudhary, ERS/ OS (Parcel), DRM Office, New Delhi present in person.
Appellant's representative narrated the genesis of instant matters to be non- grant of LAP HAP leaves to him on medical grounds while working as Sr. DCM under Railway Authorities as against the other equally placed employee and also the irregularities noted from the concerned third party's side which led the Appellant to file the RTI Applications on behalf of her client. He expressed the dissatisfaction to the fact that relevant information has not been furnished by the CPIOs till date.
CPIOs submitted that point-wise reply has already been provided to the Appellant.
Decision:
The Commission at the outset observes from a perusal of records that the instant Appeals are not maintainable in view of the judgement passed by the Hon'ble Madras High Court in the case titled N. Saravanan vs. The Chief Commissioner / 2nd Appellant Authority & Ors., W.P. (MD) No. 4336 of 2017 dated 15.03.2017 wherein it was held as under -
"...4.The first respondent dismissed the appeal on the premise that the petitioner being a practising advocate cannot seek information relating to the cases instituted by him on behalf of his client. As a citizen he can personally ask for information but not as an advocate on behalf of his client. The reasoning given by the first respondent cannot be faulted at all. The second appeal filed by the petitioner has been rightly rejected, as otherwise, every practising advocate would invoke the provisions of the R.T.I. Act for getting information on behalf of his client, which situation does not advance the objects of the scheme of the R.T.I. Act. The laudable objects of the R.T.I. Act cannot be used for personal ends and should not become a tool in the hands of the advocate for seeking all kinds of information in order to promote his practise.Page 6 of 7
5.In such circumstances, the order of the 1st respondent, dismissing the Second Appeal filed by the petitioner does not suffer from infirmity and does not call for interference. Therefore, the Writ Petition is devoid of merits and substance and the same is dismissed. There shall be no order as to costs."
In view of the applicability of the above ratio, the Commission finds no infirmity in the replies provided by the Respondent besides the Appeals not being maintainable.
Instant appeals are dismissed, accordingly.
