O R D E R
1. Leave granted.
2. The appellant challenges the judgment and order dated 23.01.2025 in CRM M-1644 of 2025 passed by the High Court of Punjab & Haryana at Chandigarh, titled “Gurbachan Singh vs. State of Punjab”.
3. On 24.02.2025, this Court passed the following order:-
“1. Mr.Raghavendra Mohan Bajaj, learned counsel appearing for the complainant - Seema Bhalla, has entered appearance.
2. On oral request, complainant - Seema Bhalla, is impleaded as party respondent. The particulars of the complainant is as follows:-
“Seema Bhalla, 59 years, W/o Ashwani Bhalla Ad-#5 Opp Geeta Mandir, Geeta Vihar Colony, Ludhiana – 142021”
3. Let amended memo of parties be filed within next two working days.
4. Issue notice, returnable on 09.04.2025.Signature Not Verified Digitally signed by NAVEEN D
5. Dasti service, in addition, is permitted.Date: 2025.05.20 17:19:31 IST Reason:
Steps for service be taken within two weeks.
6. Learned counsel for the petitioner is 1 permitted to serve the learned standing counsel for the State of Punjab.
7. Newly impleaded respondent/complainant shall file counter within one week. Rejoinder thereto, if any, be filed before next date of listing.
8. List on 09.04.2025.
9. In the event of arrest in connection with FIR No.265 of 2024 of Sadar Ludhiana Police Station, the petitioner shall be released on bail, on the appropriate terms and conditions as may be fixed the Trial Court.”
4. We allow the present appeal by confirming the order dated 24.02.2025 passed by this Court, with a direction to the appellant to continue to cooperate during the trial and not to take any unnecessary adjournment.
5. If the Trial Court feels that the trial is delayed on account of the appellant’s conduct, it shall be open to the Trial Court to take appropriate steps in accordance with the law, including cancellation of bail.
6. The impugned order dated 23.01.2025 in CRM M-1644 of 2025 passed by the High Court of Punjab & Haryana at Chandigarh, titled “Gurbachan Singh vs. State of Punjab” is set aside.
7. Pending application(s), if any, shall stand disposed of.
