JUSTICE FARJAND ALI Order 21/03/2022 After arguing to some extent, learned counsel for the petitioner prays for withdrawal of the bail application with liberty to renew the prayer after the statement of the prosecutrix is recorded in the trial.
The same is permitted.
Accordingly, the bail application is dismissed as withdrawn.
However, looking to the fact that the petitioner is in incarceration since September, 2021 and the other peculiar circumstances of the case, thus, this Court deems it appropriate to direct the learned Trial Court to record the statement of the prosecutrix as a first witness. Sincere endeavors shall be made to summon and record her statement preferably within two months from the date of receipt of this order.
