1. The present petition impugns circular dated 02.03.2022 issued by the DDA vide which the Petitioner has been denied possession.
2. The learned counsel for the Petitioner states that the Petitioner has been allotted MIG Plot bearing No. 58, Pocket A 1, Sector-37, Rohini, Delhi admeasuring 60 sq. m ('Subject Plot').
3. He states that the Petitioner has made the entire payment of Rs. 17,00,000/- in two instalments on 27.12.2019 and 15.02.2021 respectively. He states that in this manner the entire demand letter dated 09.02.2018 has been paid in full.
4. He states that however, the formalities for possession have not been completed by the Respondent, DDA relying upon the impugned circular. He states similar matters, wherein the challenge to the circular dated 02.03.2022 is pending, are next listed on 26.04.2023.
5. Issue notice, the learned standing Counsel for the Respondent who Signature Not Verified Digitally Signed By:PRAMOD KUMAR VATS Signing Date:10.03.2023 16:55:55 appears on advance notice accepts notice and seeks four (4) weeks' time to file his counter affidavit.
6. Rejoinder thereto, if any, be filed within a period of two (2) weeks thereafter.
7. In the meantime, Respondent is directed not to create any third-party rights in respect of the Subject Plot i.e., MIG Plot bearing No. 58, Pocket A 1, Sector-37, Rohini, Delhi.
8. List the matter on 26.04.2023, along with batch matters.
