ORAL ORDER
12 12-09-2023Heard Ms. Nivedita Nirvikar, learned senior counsel for the Central Bureau of Investigation (in short 'C.B.I.').
Learned senior counsel has informed this Court that despite all efforts taken at her end, no fruitful discussion could take place because all the records of this case were returned to the concerned department and the C.B.I. Head Office was not in possession of any of the records. This Court, however, called upon the learned senior counsel to assist this Court by going into the records particularly the report of the C.B.I. and let the Court know whether the appointments which have been termed Patna High Court CWJC No.20636 of 2021(12) dt.12-09-2023 12/12 'irregular' in the report are in fact in the nature of 'illegal appointments.' Learned senior counsel has, after going through some of the names and the manner in which appointments have been done, pointed out that the cases in which the appointments have been made without any advertisement and without there being any select committee and without there being any interview by such appointing authorities who had no authority to make regular appointments are definitely in the nature of illegal appointments.
Learned counsel for the parties have concluded their arguments.
