2. Challenge in this O.A is to orders Annexure A-8 to Annexure A-15 whereby services of the applicants were terminated after their appointments were cancelled due to cancellation of result of relevant examination on the ground of use of unfair means.
3. Sh. R.K. Malik, Sr. Advocate for the applicants has relied upon an order passed by the Ahemdabad Bench of this Tribunal in O.A No. 478/2015 along with others O.As which were allowed and impugned orders therein were set aside. He also placed reliance upon a similar order passed by the Principal Bench of this Tribunal in O.A No. 4179/2015 titled Ravinder Kumar & Ors. Vs. Union of India & Ors. decided on 08.04.2016 on the basis of order passed by Ahemdabad Bench, as noticed above. The orders passed by the Ahemdabad Bench of this Tribunal became the subject matter in judicial review at the hands of the respondents, before the Honble Gujarat High Court in number of special civil application, one of them SCA No. 10049/2016. Honble High Court vide its order dated 16.08.2016, quashed the order passed by the Ahembdabad bench and that order became the subject matter in SLP No. 30550/2016 tiled Monu Tomar Vs. Union of India where the Honble Supreme Court vide its interim order dated 28.10.2016 directed the respondents therein not to fill the 196 vacancies pending SLP.

He very fairly submitted that since SLP is pending for adjudication before the Honble Supreme Court in case of Monu Tomar (supra), therefore, these petitions be disposed of to await the decision in the pending SLP and same interim order be passed restricting the respondents from filling up the 74 vacancies in Haryana Circle for all the applicants in all O.As. Being relevant, order dated 28.10.2016 passed by the Honble Supreme Court reads as under:-
We are informed that there are 652 posts of Postal Assistant and Sorting Assistant which are required to be filled up as on today.
There are 196 appellants before use in these appeals.
In the circumstances, we permit the respondents to fill up the above mentioned posts, however, subject to the condition that they shall not fill up 196 posts.
List these appeals for hearing after the summer vacation in the year 2017.
5. Sh. Ram Lal Gupta, counsel for the respondents could not dispute about the disposal of O.As in requested manner. However, he prayed that the authorities may be given liberty to move an application for modification of order, if need arises.
6. Learned counsels for the applicants as well as respondents also prayed that they be given liberty to move an application for revival of O.A with additional pleas after the decision of the pending SLP, if need arises.
7. Considering the submission of the parties coupled with the interim order passed by the Honble Supreme court in case of Monu Tomar (supra), we dispose of all these O.As with a liberty to either of the parties to move an application for revival of petitions after the decision in the pending SLP, if need arises. The respondents herein are also directed not to fill up the 74 vacancies in Haryana circle till SLP is decided by the Honble Supreme Court.
