Statement of Shri Swaran Singh, the respondent on oath.
I am ready and willing to compromise the present appeal i.e. FA No. 667.2009 as well as the criminal complaint lodged vide FIR No. 309/2005 Police Station Nangloi, New Delhi u/s 337/304 IPC subject to the condition that the appellant/BSES Rajdhani Power Limited pays to me in all an amount of Rs.4,00,000/-. I shall give my consent to quashing of the FIR No. 309/2005 Police Station Nangloi, New Delhi in the Honble High Court of Delhi as and when I am called upon to appear there. I am willing to receive the said payment of Rs.4,00,000/- in the High Court of Delhi at the time of quashing of the aforesaid FIR.

I have heard the statement made by the respondent Shri Swaran Singh. I, on behalf of my client i.e. BSES Rajdhani Power Ltd. accept the same as correct. The appellant shall pay the amount of settlement of Rs.4,00,000/- to the respondent in the High Court of Delhi at the time of quashing of the FIR No. 309/2005 Police Station Nangloi, New Delhi . I, therefore, do not press the appeal further and withdraw the same.
R. O. & A.C. In view of the statements made by the parties, matter is disposed of as compromised. Appellant i.e. BSES Rajdhani Power Ltd. shall institute the appropriate proceedings for quashing of the FIR No. 309/2005 Police Station Nangloi, New Delhi in the High Court of Delhi in which the respondent Shri Swaran Singh shall give his consent. The amount of Rs.4,00,000/- shall be paid at that time by way of a Demand Draft.
Parties to honour their statements. File be sent to records. FDR if any be released in favour of appellant after completing all formalities.
