Counsel submits that this fact was not brought to the notice of the Court that on the date when the order came to be passed by this Court on application filed by the respondent-workman U/s 17B of the Industrial Disputes Act,1947 the workman was 68 years of age as is evident from the affidavit which he filed along with application U/s 17B of the Act,1947.
Copy of the application may be served upon Mr. Suresh Kashyap who was appearing for respondent workman in the main petition. List after winter vacation.
