CORAM: HON'BLE MR JUSTICE S.G.PANDIT and HON'BLE MR JUSTICE T.M.NADAF CAV ORDER (PER: HON'BLE MR JUSTICE S.G.PANDIT) Since the petitioners in all the above writ petitions have prayed for a common relief and as the contentions are common, the same are taken up together and disposed of by this common order.67
2. Though the matters are listed in orders, with the consent of learned counsel appearing for the parties, the matters are taken up for final disposal.
3. Petitioners are before this Court under Article 226 of the Constitution of India questioning the correctness and legality of order dated 16.10.2024 in Application Nos.2934-3112/2024 passed by the Karnataka State Administrative Tribunal at Bengaluru (for short, 'the Tribunal') rejecting their challenge to draft and final notification dated 27.02.2024 (Annexure-A5) and final notification dated 13.03.2024 (Annexure-A9) creating the post of Senior Panchayat Development Officer and creating the post of Panchayat Development Officer (for short, 'PDO') as a State Cadre under Schedule-II to the Karnataka General Services (Development Branch and Local Government Branch) (Cadre and Recruitment) Rules, 2024 (for short, '2024 Rules').68
4. Brief facts of the case are that, the petitioners in the above three batches of writ petitions are either in the cadre of Panchayat Development Officers or Gram Panchayat Secretary and Rural Development Assistant (Grade-I) (for short, 'Secretary'). All the petitioners are appointed prior to 2024 Rules. Under the Karnataka General Service (Development Branch and Local Government Branch) (Recruitment of Panchayat Development Officers and Gram Panchayat Secretary and Rural Development Assistant Grade-I) (Special) Rules, 2014 (for short, '2014 Rules'), majority of the petitioners are appointed as Panchayat Development Officers or as Gram Panchayat Secretary and Rural Development Assistant (Grade-I). For the purpose of appointment, Special Selection Committee was constituted under 2014 Rules. Under 2014 Rules, Appointing Authority was defined as Chief Executing Officer of Zilla 69 Panchayat of the respective Districts. In terms of 2014 Rules, the post of PDO and Secretary were district wise posts. Under Government order dated 29.03.2023 (Annexure-A4), pending amendment to Karnataka General Services (Development Branch and Local Government Branch) (Cadre and Recruitment) Rules, 2008 (for short, '2008 Rules'), post of Senior PDO and method of recruitment to Senior PDO as well as PDOs was prescribed. The said Government order was the subject matter of challenge before the Tribunal in Application Nos.2189-2215/2023. The Tribunal by order dated 12.10.2023 (Annexure-A10) observed that Government Order dated 29.03.2023 is not actionable unless it is incorporated duly in the respective C and R Rules. Taking note of the same, the State took steps to amend the 2008 Rules by issuing draft notification dated 27.02.2024 (Annexure-
A5) inviting objections/suggestions to create the post 70 of Senior PDO and to make the post of PDO State Cadre. Thereafter, under notification dated 13.03.2024 (Annexure-A9), 2024 Rules were issued creating the post of Senior PDO and treating the post of PDO as State Cadre under Schedule-II to 2024 Rules. Questioning the draft and final Rules, the petitioners and others were before the Tribunal in Application Nos.2934-3112/2024 and the Tribunal under impugned order dated 16.10.2024 rejected the Applications as there is no sufficient ground to interfere. Aggrieved by the said order, the petitioners are before this Court.
5. Heard learned senior counsel Sri.D.R.Ravishankar for Smt.Siri Rajashekar for petitioners in W.P.No.11950/2025, Sri.M.P.Srikanth, learned counsel for petitioners in W.P.No.16937/2025 and W.P.No.18825/025, Learned Additional Advocate General Sri.Reuben Jacob for Sri.V.Shiva Reddy, 71 learned Additional Government Advocate for respondents-State. Perused the entire writ petition papers as well as the original records produced by the State.

Learned senior counsel Sri.D.R.Ravishankar would contend that the impugned Rules treating the post of PDO as 'State' cadre from that of 'District' cadre is arbitrary, unreasonable and the same would affect the service condition of the petitioners. Learned senior counsel would also submit that the procedure prescribed under the Karnataka Civil Services Act, 1978 (for short, 'KCS Act') is not followed while amending the 2008 Rules under 2024 Rules. It is submitted that 15 days time granted to file objections/suggestions was not sufficient and inadequate. As the time was inadequate, the petitioners were not in a position to file their objections/suggestions effectively.
727. Learned senior counsel further contended that conversion of PDO posts from 'District' to 'State' cadre is arbitrary and he submits that 2024 Rules operates retrospectively which affects the service conditions of those already in service and it alters the service condition of the existing PDOs. Further elaborating his arguments, learned senior counsel would submit that the Appointing Authority in relation to the petitioners was Chief Executive Officer of the Zilla Panchayat, however, under 2024 Rules, the Appointing Authority in relation to PDOs is Commissioner. Moreover, he submits that prior to amendment, transfer of PDOs in relation to the petitioners was within the district and by virtue of 2024 Rules the petitioners would be liable for transfer out of district and all over the State, which would change their condition of service.
738. Learned senior counsel would further submit that 2024 Rules is finalized without following the procedure prescribed under KCS Act and the Rules is not laid before the house as required. As such, it is submitted that 2024 Rules cannot be enforced. Thus, learned senior counsel would pray for allowing the writ petition and to quash the impugned 2024 Rules.
9. Learned counsel Sri.M.P.Srikanth supporting the contentions raised by learned senior counsel Sri.D.R.Ravishankar, adds that 2024 Rules is unreasonable and arbitrary insofar as it affects condition of service of the petitioners. It is submitted that at the time of appointment of petitioners, the State assured the petitioners that the post of PDO is 'District' wise and they would not be liable for transfer out of the 'District'. Contrary to the same, under 2024 Rules, the post of PDO is made 'State' wise cadre and PDOs are made transferable all over the State.
74Learned counsel would submit that 2024 Rules are finalized without there being any consultation with the Association of the PDOs or with the concerned Departments. Therefore, he submits that as there is violation of procedure prescribed under KCS Act, impugned notifications are liable to be quashed. He also submits that as a model employer, the State shall not act arbitrarily and it shall protect the interest of its employees. Thus, he prays for allowing the writ petition.
10. On the other hand, learned Additional Advocate General Sri.Reuben Jacob appearing for the State vehemently opposes the prayer of the petitioners and submits that as contended, the impugned Rules would not suffer from arbitrariness or unreasonableness. It is submitted that the Court would not lightly interfere with the enactments, unless it is shown that it violates fundamental rights, 75 competency to make law or the same is manifestly arbitrary. Learned Additional Advocate General would submit that the petitioners have utterly failed to point out any of the above to interfere with the impugned Rules. It is submitted that Section 3 of KCS Act requires providing 15 days time from the date of publishing the provisional rules to file objections/suggestions. Thereafter on considering the objections, it is for the State to proceed further to finalize the same. It is submitted that in the instant case, 15 days time was provided and the objections/suggestions submitted by the Association was considered before finalizing the impugned Rules.
11. Learned Additional Advocate General would submit that impugned Rules would not act retrospectively, but it would act in future. It is specifically submitted by learned Additional Advocate General that the impugned Rules would not take away 76 the accrued or existing right or benefit of the petitioners. In that regard, learned Additional Advocate General places reliance on the decision of the Hon'ble Apex Court in the case of CHAIRMAN, RAILWAY BOARD AND OTHERS VS.
C.R.RANGADHAMAIAH AND OTHERS1. It is submitted that the conversion of the post of PDO from 'District' to 'State' cadre would not affect the service condition of the petitioners in any manner. It is stated that petitioners are appointed to transferable post and transfer is not a condition of service and it is only an incidence of service. Therefore, he submits that the petitioners cannot have any grievance in respect of making the post of PDO a 'State' cadre.
12. With regard to the contention of the learned counsels for the petitioners that the Rules was not laid before the house as required, he would submit 1 (1997) 6 SCC 623 77 that laying of Rule on the table of the houses is merely directory and it is not mandatory. In that regard, he places reliance on the decision of the Co-
ordinate Bench dated 08.09.2021 in the case of SRI.AMITH.S., AND OTHERS VS. THE STATE OF KARNATAKA AND OTHERS2. Thus, learned Additional Advocate General would pray for dismissal of the writ petitions.
13. Having heard the learned counsel appearing for the parties and on perusal of the writ petition papers, the following points would arise for consideration:
a) Whether the impugned 2024 Rules are arbitrary insofar as making the post of PDO from 'District' to 'State' cadre?
b) Whether the impugned order passed by the Tribunal requires interference?2

14. Answer to both the above points would be in the Negative for the following reasons:
It is a settled position of law that the presumption is always in favour of Constitutionality or validity of Statute or Rules with regard to Post-
Constitutional Laws. The scope of judicial review in the matter of challenge to the Constitutional validity of a statute or Rule is very limited. Unless it is shown that the enactment violates fundamental rights; that the legislature did not posess the competence to enact; or that enactment is manifestly arbitrary, writ Courts shall not interfere.
15. The Hon'ble Apex Court in the case of DR.JAYA THAKUR VS. UNION OF INDIA AND OTHERS3 while examining the Constitutional validity of Central Vigilance Commission (Amendment) Act, 3 (2023) 10 SCC 276 79 2021, at paragraphs 68, 70, 71, 72 and 74 held as follows:
"68. It could thus be seen that the role of the judiciary is to ensure that the aforesaid two organs of the State i.e. the legislature and the executive function within the constitutional limits. Judicial review is a powerful weapon to restrain unconstitutional exercise of power by the legislature and executive. The role of this Court is limited to examine as to whether the legislature or the Executive has acted within the powers and functions assigned under the Constitution. However, while doing so, the Court must remain within its self-imposed limits.
70. It could thus be seen that this Court has held that the statute enacted by Parliament or a State Legislature cannot be declared unconstitutional lightly. To do so, the Court must be able to hold beyond any iota of doubt that the violation of the constitutional provisions was so glaring that the legislative provision under challenge cannot stand. It has been held that unless there is flagrant violation of the constitutional provisions, on the law made by 80 Parliament or a State Legislature cannot be declared bad.
71. It has been the consistent view of this Court that legislative enactment can be struck down only on two grounds. Firstly, that the appropriate legislature does not have the competence to make the law; and secondly, that it takes away or abridges any of the fundamental rights enumerated in Part III of the Constitution or any other constitutional provisions. It has been held that no enactment can be struck down by just saying that it is arbitrary or unreasonable. Some or the other constitutional infirmity has to be found before invalidating an Act. It has been held that Parliament and the legislatures, composed as they are of the representatives of the people, are supposed to know and be aware of the needs of the people and what is good and bad for them. The court cannot sit in judgment over their wisdom.
72. It has been held by this Court that there is one and only one ground for declaring an Act of the legislature or a provision in the Act to be invalid, and that is if it clearly violates some provision of the Constitution in so evident a 81 manner as to leave no manner of doubt. It has further been held that if two views are possible, one making the statute constitutional and the other making it unconstitutional, the former view must always be preferred. It has been held that the Court must make every effort to uphold the constitutional validity of a statute, even if that requires giving a strained construction or narrowing down its scope.
74. It could thus be seen that the challenge to the legislative Act would be sustainable only if it is established that the legislature concerned had no legislative competence to enact on the subject it has enacted. The other ground on which the validity can be challenged is that such an enactment is in contravention of any of the fundamental rights stipulated in Part III of the Constitution or any other provision of the Constitution. Another ground as could be culled out from the recent judgments of this Court is that the validity of the legislative Act can be challenged on the ground of manifest arbitrariness. However, while doing so, it will have to be remembered that the presumption is 82 in favour of the constitutionality of a legislative enactment."
16. In the instant case, the petitioners have failed to point out as to how the impugned 2024 Rules would violate any of their fundamental or statutory rights; failed to point out that the authority lacks competence to enact the Rules; or that the impugned action of the State in making the post of PDO a 'State' cadre is manifestly arbitrary or unreasonable. The petitioners have also failed to point out how the impugned action of the State affects their service condition, except stating that their Appointing Authority would be changed and that they would be liable for transfer outside the District to all over the State. It is true that at the time of appointment of petitioners, the Appointing Authority in relation to them was the Chief Executive Officer of Zilla Panchayat and they could be transferred within the 83 District. The change of Appointing Authority would in no way affect that service condition of the petitioners.
When the post of PDO has been made 'State' cadre, the Commissioner has been made Appointing Authority, who is higher in rank than the Chief Executive Officer of Zilla Panchayat. Moreover, the petitioners' appeal remedy is also intact and they could appeal to the Higher Authority if any order, adverse to them is passed by the Appointing Authority the Commissioner. In the matter of transfer, as held by the Hon'ble Apex Court in B.VARADHA RAO VS.
STATE OF KARNATAKA AND ANOTHER4, transfer is not a condition of service and it is an incidence of service. When the petitioners have accepted a transferable appointment, they would be liable for transfer all over the State. They cannot raise any objections to transfer and they cannot claim to be in a 4 (1986) 4 SCC 624 84 particular post or particular place. The contention of the petitioners that 2024 Rules operates retrospectively which affects their service condition cannot be accepted for the above reasons as well as on the principles laid down by the Hon'ble Apex Court in CHAIRMAN, RAILWAY BOARD AND OTHERS (supra). In the said case, it is held that the terms of service of an employee who is governed by statute or statutory rules could be unilaterally altered without the consent of the employees. It is also held that mere contention of retrospectivity of Rules cannot be a ground to assail the Rules. At paragraphs 16, 19 and 20, the Hon'ble Apex Court has observed as follows:
"16. It is no doubt true that once a person joins service under the Government the relationship between him and the Government is in the nature of status rather than contractual and the terms of his service while he is in employment are governed by statute or statutory rules, which may be unilaterally altered without the consent of the 85 employees. It has been so held by this Court in Roshan Lal Tandon [AIR 1967 SC 1889 : (1968) 1 SCR 185 : (1968) 1 LLJ 576] and State of J&K v. Triloki Nath Khosa [(1974) 1 SCC 19 : 1974 SCC (L&S) 49 : (1974) 1 SCR 771] (SCR at pp. 779, 780 : SCC p. 29, para 16). It may, however, be mentioned that in Roshan Lal Tandon [AIR 1967 SC 1889 : (1968) 1 SCR 185 : (1968) 1 LLJ 576] the petitioner was invoking his rights under the contract of service and the said contention was rejected by the Court with the observation:
"We are therefore of the opinion that the petitioner has no vested contractual right in regard to the terms of his service and that the counsel for the petitioner has been unable to make good his submission on this aspect of the case."[p. 196]
19. In Triloki Nath Khosa [(1974) 1 SCC 19 : 1974 SCC (L&S) 49 : (1974) 1 SCR 771] rules had been framed altering the criterion of eligibility for promotion from the post of Assistant Engineer to the post of Executive Engineer and the same were challenged on the ground of retrospectivity by the Assistant Engineers who were in service on the date of making of these rules. Rejecting the said contention, this Court said: (SCC pp. 28-29, para 16) 86 "16. ... It is wrong to characterise the operation of a service rule as retrospective for the reason that it applies to existing employees. A rule which classifies such employees for promotional purposes, undoubtedly operates on those who entered service before the framing of the rule but it operates in futuro, in the sense that it governs the future right of promotion of those who are already in service. The impugned rules do not recall a promotion already made or reduce a pay scale already granted. They provide for a classification by prescribing a qualitative standard, the measure of that standard being educational attainment. Whether a classification founded on such a consideration suffers from a discriminatory vice is another matter which we will presently consider but surely, the rule cannot first be assumed to be retrospective and then be struck down for the reason that it violates the guarantee of equal opportunity by extending its arms over the past. If rules governing conditions of service cannot ever operate to the prejudice of those who are already in service, the age of superannuation should have remained immutable and schemes of compulsory retirement in public interest ought to have foundered on the rock of retroactivity. But such is not the implication of service rules nor is it their true description to say that because they affect existing employees they are retrospective."
20. It can, therefore, be said that a rule which operates in futuro so as to govern future rights of those already in service cannot be assailed on the 87 ground of retroactivity as being violative of Articles 14 and 16 of the Constitution, but a rule which seeks to reverse from an anterior date a benefit which has been granted or availed of, e.g., promotion or pay scale, can be assailed as being violative of Articles 14 and 16 of the Constitution to the extent it operates retrospectively."
17. The Hon'ble Apex Court in the case of P.U.JOSHI AND OTHERS VS. ACCOUNTANT GENERAL, AHMEDABAD AND OTHERS5 was considering the challenge of bifurcation and re-
structuring of cadres in the Indian Audit and Accounts Department relating to the Office of the Accountant General in the States. The Hon'ble Apex Court held that constitution, pattern, nomenclatures of posts, cadres, categories, their creation/abolition, prescription of qualifications and other conditions of service pertain to the field of policy is within the exclusive discretion and jurisdiction of the State.
5(2003) 2 SCC 632 88 Further, it has also held that there is no right in any employee of the State to claim that Rules governing conditions of his service should be forever the same is as the one when he entered service for all purposes.
Relevant paragraph 10 reads as follows:
"10. We have carefully considered the submissions made on behalf of both parties. Questions relating to the constitution, pattern, nomenclature of posts, cadres, categories, their creation/abolition, prescription of qualifications and other conditions of service including avenues of promotions and criteria to be fulfilled for such promotions pertain to the field of policy is within the exclusive discretion and jurisdiction of the State, subject, of course, to the limitations or restrictions envisaged in the Constitution of India and it is not for the statutory tribunals, at any rate, to direct the Government to have a particular method of recruitment or eligibility criteria or avenues of promotion or impose itself by substituting its views for that of the State. Similarly, it is well open and within the competency of the State to change the rules 89 relating to a service and alter or amend and vary by addition/substraction the qualifications, eligibility criteria and other conditions of service including avenues of promotion, from time to time, as the administrative exigencies may need or necessitate. Likewise, the State by appropriate rules is entitled to amalgamate departments or bifurcate departments into more and constitute different categories of posts or cadres by undertaking further classification, bifurcation or amalgamation as well as reconstitute and restructure the pattern and cadres/categories of service, as may be required from time to time by abolishing the existing cadres/posts and creating new cadres/posts. There is no right in any employee of the State to claim that rules governing conditions of his service should be forever the same as the one when he entered service for all purposes and except for ensuring or safeguarding rights or benefits already earned, acquired or accrued at a particular point of time, a government servant has no right to challenge the authority of the State to amend, alter and bring into force new rules relating to even an existing service."90

In the instant case also, the contention of the petitioners is that their service condition shall not be changed and in that, their appointing authority shall not be changed from Chief Executive Officer of Zilla Panchayath to that of State Level Officer i.e., Commissioner. The above decision of the Hon'ble Apex Court in P.U.JOSHI (supra) would aptly apply to facts of the the present case.
19. It is also contended that 15 days time provided to file objections/suggestions was not sufficient and that the procedure of tabling the Rule on the houses is not followed. Section 3 of KCS Act provides only 15 days time to file objections/suggestions to provisional notification and what is prescribed under the provision was provided, as such, the petitioners cannot have any grievance.
Moreover, the objections filed by the Association of PDOs was considered, as could be seen from the 91 Cabinet Note, which was made available during the course of hearing. The Cabinet Note also indicates the consultative process with the other concerned departments.
20. A Co-ordinate Bench of this Court in Sri.Amith S., (supra) was examining the validity of the Karnataka Public Works Department (Special Recruitment of Assistant Engineers Grade-I and Junior Engineers) (Repeal), Rules 2020, wherein, a similar contention of failure to table the Rules before the houses was raised. Considering Section 8 of KCS Act, at paragraphs 19, 20 and 21, it was held that laying of Rules before both the houses cannot be held to be mandatory and it is only directory in nature. Relevant paragraphs read as follows:
"19. A plain reading of above provisions would clearly indicate that every Rule made by the State has to be laid before both the houses of Legislature when in session for a total period 92 of 30 days and if any modification is made in the Rule and if both the houses agree for making any such modification or that there is no modifications required, the Rule, thereafter, would have an effect only in such modified form to be or no effect as the case may be. Therefore, once the Rule is laid before both the houses, the said Rule will come into force and into effect.
20. Therefore, it is only a procedural formality to lay the said Rule before both the houses for modifications, if any, to the Rules sought to be made. Hence, it cannot be contended by the petitioners that there is any violation of Section 8 of the Karnataka Civil Service Act, 1978. It is the clear intention of legislature under the aforesaid enactment that any rule made under the Act has to be laid as soon as may be after it is made, before each House of the State Legislature, which it is in session for a total period of thirty (30) days, which may be comprised in one session or in two or more successive sessions and if before the expiry of the session in which it is so laid or the sessions immediately following both Houses agree in making any modification in the rule or both the 93 Houses agree that the rule should not be made, the rule will have effect only in such modified form or be of no effect, as the case may be. Thus, laying of Rule on the table of the houses for the period provided is merely directory and it is not mandatory and it cannot be a ground to declare the Rule as ultra vires. The Hon'ble Apex Court in the matter of VENEET AGARWAL v. UNION OF INDIA reported in (2007)13 SCC 116, wherein a similar issue had come up, has held:
"15. This apart the issue relating to the laying down of rules/regulations on the table of the Houses for the period provided under the statute under which they are so framed has been dealt with by this Court in various cases. Some of these cases are Jan Mohammad Noor Mohammad Bagban V. The State of Gujarat & Another, 1966 (1) SCR 505, M/s. Atlas Cycle Industries Limited & Others V. The State of Haryana, 1979 (2) SCC 196, Hukum Chand V. Union of India, 1972 (2) SCC 601, and Bank of India etc. etc. V. O.P. Swarnakar & Others etc. etc., 2003 (2) SCC 721. In a recent judgment, this Court followed the view taken in M/s. Atlas Cycle Industries Limited's case (supra) 94 and Prohibition & Excise Suptd., A.P. & Ors. V. Toddy Tappers Cooperative Society, Marredpally and Others, 2003 (12) SCC 738.
16. In all these cases, the issue relating to laying down and interpretation of the said regulation was examined. It has been held in all these cases that the laying of the rule before both the Houses of Parliament is merely a directory rule and not mandatory. In the Case of O.P. Swarnakar & Others (Supra), the provision providing for laying the rules before the Legislative was exactly similar to Section 31 of the SEBI Act. It was also held by this Court that the said provision was directory and not mandatory. The non-compliance with the laying of the rule before the Parliament was not a sufficient ground to declare the rules/regulations framed under the statute as to be ultra vires. In Toddy Tappers Cooperative Society case Honble Mr. Justice Sinha in his concurring judgment following the decision in Atlas Cycle Industries Limited case and Quarry Owners' Association V. State of Bihar, 2000 (8) SCC 655 and various other judgments, distinguishing the judgment in Union of India V. National Hydroelectric Power Corporation Limited, 2001 (6) SCC 307, (which has been relied upon by counsel for the appellant before us as well) has held as under:-
"32. The said observations, thus, must be held to be confined to the fact of the matter obtaining therein. In that case it was found as of fact that the rule had never been placed before the Legislature 95 and, thus, there was even no substantial compliance with the law. The Bench, however, did not consider the effect of the directory nature of such a provision, in the light of the decision of this Court in Atlas Cycle Industries and Quarry Owners' Association. The Court further did not notice the difference between the expressions 'approval' and 'permission'. Section 16 of the Water Act, construction whereof was in question did not use the expression 'prior approval'. The word 'approval' indicates an Act which has already been made and is required to be approved whereas in the case of 'permission', the situation would be different. This aspect of the matter has been considered by this Court in High Court of Judicature for Rajasthan v. P.P. Singh and Anr, 2003 (4) SCC 239 stating : (SCC p. 255, para 40).
'40. When an approval is required, an action holds good. Only if it is disapproved it losses its force. Only when a permission is required, the decision does not become effective till permission is obtained. (See U.P. Avas Evam Vikas Parishad and Anr. v. Friends Coop. Housing Society Ltd and Anr. [(1995) Supp (3) SCC 456], In the instant case both the aforementioned requirements have been fulfilled.'

It was observed that provision was merely directory and not mandatory and even if the rules were not laid before the House at all even then the non- compliance with the laying down of the 96 rules before the Parliament could not be a ground to declare the rules/regulations framed under the statute as ultra vires.
18. Although in the present case the rules were laid before both the Houses as required under Section 31, as discussed in the earlier paragraph of the judgment but even if it is assumed that the rules/regulations in question did not complete the requisite period of 30 days, the provisions of Section 31 of the SEBI Act not being mandatory and merely directory, as has been held by this Court in the aforementioned cases, the rules/regulations cannot be held to be ultra vires on the ground of non-completion of 30 days period after laying of the rules before both the Houses of Parliament."
21. Therefore, we are of the view that there is force in the submissions made by the learned Additional Advocate General on behalf of the State that laying of Rules before both the houses cannot be held to be mandatory as it is only directory in nature."

Learned counsel Sri.M.P.Srikanth submitted that some of the petitioners who are in the cadre of Secretary cadre would be affected by treating the PDO post as 'State' cadre, since their cadre is of 'District' 97 wise and their next promotion would be to the post of PDO. At present, the Secretaries are not the aggrieved persons as their service conditions are not affected in any manner. Their promotion to next higher cadre is not denied and they would be entitled for promotion to the 'State' cadre of PDO.
22. Learned senior counsel also contended that modalities of conversion or merger of the cadre of PDO from 'District' to 'State' are not prescribed and as the Rules are incomplete or silent in that regard, 2024 Rules cannot be implemented.
23. As contended by learned senior counsel, there is no merger or conversion of PDO post with any other post or cadre. The 2024 Rules treats the PDO cadre as 'State' cadre in place of 'District' cadre. To treat the 'District' cadre as 'State' cadre post, there need not be any modalities. When the promotion to 98 next higher cadre is to be effected, the State has to promote PDOs based on the finalized State wide seniority list prepared in terms of Rule 7 of the Karnataka Civil Services (Seniority) Rules, 1957.
24. For the reasons recorded above, there is no merit in any of the contentions raised by the petitioners. Accordingly, writ petitions stand dismissed.
