HIGH COURT OF ANDHRA PRADESH AT AMARAVATI

MAIN CASE No.: WP.No.17232 OF 2021

                             PROCEEDING SHEET

S.No DATE ORDER

 18 17.10.2022 DEV, J

In compliance of the Order dated
01.08.2022, the enquiry report is filed before
                    the Court.
On perusal of the record, it appears that
the petitioner has submitted a Complaint,
dated 27.11.2020, to the 3rd respondent

marking copies to several Government Officers including the Hon'ble Chief Minister of Andhra Pradesh, the Hon'ble Minister for Medical and Health, Commissioner for Medical and Health and also to the Director General of Police and other Officers, requesting to conduct enquiry against the death of his wife and if necessary, he requested to conduct re-postmortem and take appropriate action against the management of the 6th respondent hospital, who is responsible for the death of his wife. It also appears from the record, till date i.e., even lapse of two years, the said complaint is not considered and no action is initiated.

Today, Dr. Sumaya Khan, District Medical and Health Officer, Guntur, Guntur District, who is the third respondent is present before this Court.

She submits that, she joined in that post on 11.07.2022 and as such, she is not aware of the complaint submitted by the petitioner. She further submitted that, the sixth respondent - hospital is closed. It is very unfortunate to note that the respondent authorities did not move their little finger to consider the complaint of the petitioner submitted on 27.11.2020 even after two years.

Under these circumstances, in the considered opinion of this Court, it is appropriate to call for report from the 2nd respondent i.e., Commissioner of Health and Family Welfare within a week with regard to the action taken on the complaint dated 27.11.2020 submitted by the petitioner.

Hence, the 2nd respondent is directed to submit Action Taken Report on the complaint dated 27.11.2020 submitted by the petitioner by the next date of hearing.

Post on 28.10.2022.
