UPON hearing the counsel the Court made the following
O R D E R
Sole respondent of SLP(C) No.30870/2012 has duly been served. However, none has entered appearance. The office report is silent about the counter affidavit of the sole respondent in SLP(C) No.3232/2012.
Service of the sole respondent in all the other appeals is complete. Statement of case by both the parties has been filed in C.A. No.9610, 9608, 9615, 9614/2011 and 2963/2012. In C.A. No.9612/2011 and 7941/2012, appellant has filed the statement of case but respondent has not filed the same. In C.A. No.9606/2011, respondent has filed the statement of case but the appellant has not filed the same. Both the parties have not filed the statement of case in C.A. Nos.9609, 9611, 9613, 9607/2011, 3367/2012 and 7942/2012 However, it is no more a mandate as per the amendment in the Supreme Court Rules, 2013 and in that circumstance, the List of dates already submitted is presumed to have been accepted by the parties.
All the civil appeals to be processed for being listed before the Hon'ble Court subject to the verification about the status of the sole respondent in SLP(C) No.3232/2012. Item No.121 -3- Court fee has been filed in C.A. No.9606/2011 today but not in C.A. Nos.9607/2011, 3367/2012, 7941/2012 and 7942/2012, a specific mention in the office report to this aspect be made. The appellants are at liberty to pay the court fee during the matter are being processed to be listed before the Hon'ble Court.
