CORAM: HON'BLE MR. JUSTICE SUDIP AHLUWALIA

Present: Mr. Yashdeep Nain, Advocate,
             for the petitioner.

             Mr. Anmol Malik, DAG, Haryana.

             Mr. Hardeep Kasan, Advocate,
             for the complainant.

                         ****

SUDIP AHLUWALIA, J. (ORAL)

The present petition has been filed under Section 439 of the Cr.P.C. by the petitioner, seeking regular bail in case FIR No.0297 dated 04.08.2020, under Sections 370, 384, 406, 420 and 506 of the IPC and Section 24 of the Emigration Act, registered at Police Station Pundri, District Kaithal.

2. The petitioner, who was named as accused No.3 in the FIR and happens to be the son of Puran Singh, the first accused in the said FIR, has remained in detention for nearly two months, since 06.09.2020. Careful perusal of the FIR discloses that no active role is attributed to the petitioner himself, although there are allegations against his father, as also the other co-accused persons of having cheated the complainant of a huge amount of 1 of 2 ::: Downloaded on - 12-11-2020 00:44:56 ::: CRM-M-36472-2020 -2- money on the promise of sending him to America legally on work permit.

3. From the Reply filed on behalf of the State by the Officer In- charge of the concerned Police Station (Annexure P-2) dated 28.09.2020, it is seen that it was mentioned therein that investigation against the petitioner had already been completed and the Final Report had also been prepared, which would be submitted in the Court shortly.

4. In this view of the matter, further detention of the petitioner, in the interest of investigation, for an indefinite period at this stage does not appear to be called for.

5. As such, without commenting any further on the merits of the present case as a whole and in view of the detention undergone by the petitioner, as also the fact that the trial is likely to take its own substantial time, particularly on account of the ongoing Covid-19 pandemic, the prayer of the petitioner for regular bail is allowed and he is ordered to be released on bail, subject to appropriate terms and conditions to the satisfaction of the Ld. Trial Court/Duty Magistrate, concerned.

6. Disposed off.
