ORAL ORDER
3/ 13-11-2014It has been submitted that the Petitioners are ready to produce rest of the witnesses and hence the order dated 03.06.2014 by which the 1st Additional Sessions Judge, Darbhanga, had closed evidence of the defence in Sessions Trial No.271 of 1995 be set aside.
Considering the interest of justice, one opportunity should be given and the Trial Court is directed to fix a single date for examination of three witnesses within two weeks from the date of receipt/production of a copy of this order. However, if the Petitioners are unable to produce the witnesses for any reason, no further opportunities shall be given to them.
This order is being passed on the submission that till Patna High Court Cr.Misc. No.29809 of 2014 (3) dt.13-11-2014 2/2 date argument has not been heard finally by the Trial Court. However, if it is not so, this order shall stand ignored.
The application stands disposed off with the observation/direction aforesaid.
