MR.RAJESH K. ARYA, MEMBER JUSTICE RAJ SHEKHAR ATTRI, PRESIDENT Since, the issues involved in these cases, except minor variations, here and there, of law and facts are the same, therefore, by this order, we would like to dispose of the above captioned applications filed by the applicant-Gurpreet Singh Sidhu, Managing Director/Director of Emerging India Housing Corporation Private Limited/Emerging Valley Private Limited (in short the applicant) under Section 94 read with Section 96 of Insolvency and Bankruptcy Code, 2016 (for brevity the Code) with a prayer to stay the proceedings against him on the ground that he has initiated proceedings under IBC 2016 before the Debt Recovery Tribunal-2, Chandigarh (in short DRT-2, Chandigarh), under Part III, Section 79 (1) of the Code IBC 2016, which has been assigned diary no.18534 dated 30.11.2022. Accordingly, arguments on these applications were heard.
It has been submitted by Counsel for the applicant that he has already filed other applications on 25.03.2023, before this Commission for staying the execution proceedings, on the ground that he has now filed fresh application before the National Company Law Tribunal, Chandigarh (NCLT, Chandigarh) vide diary no.00932 dated 21.03.2023. In the new applications dated 25.03.2023 a request has been made to withdraw the above captioned previous applications. He further submitted that similar application to withdraw the application under Section 94 read with Section 96 of Insolvency and Bankruptcy Code, 2016 (IBC, 2016) has also been moved before the Registrar, DRT-2, Chandigarh.
We have heard the contesting parties on these applications. At the outset, we want to express that the said application before DRT-2, Chandigarh was filed with malafide intention and ulterior motive to delay the proceedings, knowing fully well that the same is not maintainable. We have sought report from the Registrar DRT-2, Chandigarh regarding filing of application by the applicant and the Registrar DRT-2, Chandigarh has submitted his report dated 13.03.2023 relevant part of which is reproduced hereunder:-
".......Sub: Orders dated 23.02.2023 & 02.03.2023, passed by Hon'ble Justice Raj Shekhar Attri, President, Shri Rajesh Arya, Member, The State Consumer Disputes Redressal Commission, Union Territory, Chandigarh - regarding.
Sir, In reference to your letters No.SC-CP/2023/303, dated 27.02.2023, SC-CP/2023/299, dated 27.02.2023, SC-CP/2023/300, dated 27.02.2023, SC-CP/2023/301, dated 27.02.2023, SC-CP/2023/302, dated 27.02.2023 and SC-CP-2023/345, dated 06.03.2023, on the subject cited above and to enclose herewith a copy of DRT-2, Chandigarh Diary No.18534 dated 30.11.2022, filed by Sh. Gurpreet Singh Sidhu has filed Petition under Section 94 of the Insolvency & Bankruptcy Code, 2016. The above matter is pending before the scrutiny section for removal of the objections.
This is for kind information and necessary action at your end please....."
Perusal of report aforesaid reveals that though application was filed by Sh.Gurpreet Singh Sidhu, before DRT-2, Chandigarh, yet, the same was still under objections. We are of the view that uptill removal of the objections, it cannot be treated as filing of application in terms of Section 94 read with Section 96 of IBC. Besides this, no effort was made by Sh.Gurpreet Singh Sidhu to remove the said objections in the application filed before the DRT-2, Chandigarh. It transpires that filing of application and non-removal of objections therein was to cause delay qua the proceedings pending before this Commission against Sh.Gurpreet Singh Sidhu. Significantly, now Sh.Gurpreet Singh Sidhu has placed on record letter dated 17.03.2023 issued by RO-cum-HOO, DRT-2, Chandigarh, which reads as under:-
It is certified that court fee of Rs.2,000/- + Rs.5/- in case file IBC, 2016, from Gurpreet Singh Sidhu - Applicant/Personal Guarantor has been paid through Demand Draft No.000110 dated 21.11.2022 in the Debts Recovery Tribunal-2, Chandigarh vide this Tribunal Diary No.18534 dated 30.11.2022. As per Govt. website (e-drt) Notification, reproduced as under:
2. Vide letter dated 17.03.2023, Shri Gurpreet Singh Sidhu, applicant/Personal Guarantor has stated that the above matter has filed vide this Tribunal Diary No.18534 dated 30.11.2022, under Section 94 of the IBC, 2016 and now he wish to withdraw the above petition and approach for filling before the National Company Law Tribunal, Chandigarh, for further proceedings.
3. In view of the above, the above matter along with Court Fee Certificate (and a copy of DRT website one page) be issued to Shri Gurpreet Singh Sidhu Applicant/Personal Guarantor...."
From perusal of the aforesaid letter dated 17.03.2023 received from RO-cum-HOO, DRT-2, Chandigarh it is coming out that in view of Govt. website (e-drt) Notification, DRT-2, Chandigarh has not yet commenced taking up insolvency resolution and bankruptcy matters, as the related provisions are not yet in force. In this view of the matter, we are of the considered view that these applications are not maintainable and the same have been filed with malafide intentions and ulterior motive to delay the proceedings, as such, all these applications are dismissed as withdrawn with cost of Rs.2000/- each, out of which Rs.1000/- shall be paid to the complainants/decree holders, in each case and Rs.1000/- shall be deposited in the Consumer Legal Aid Account No.32892854721 (State Bank of India, Sector 7, Madhya Marg, Chandigarh) of this Commission, in each case. Certified copies of this order be sent to the parties, free of charge and copy be placed ion the connected case files. Now to come up for arguments in the fresh applications, in the afternoon, on the request of counsel for the applicant.
