B E F O R E HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH 01-08-2022 Heard Md. Ajmal Hussain, leaned counsel appearing for the petitioner and Mr. Shyam Sharma, learned Government Advocate appearing for the respondents.

The learned counsel for the petitioner made a prayer for allowing him to withdraw the present writ petition with liberty to approach the appropriate forum by filing appropriate petition.

Mr. Shyam Sharma, learned Government Advocate submitted that the petitioner has effective and alternative statutory remedies available to him under the CrPC and as such, he has objection in giving liberty to the petitioner to approach this court by filing similar petition. However, the learned Government Advocate fairly submitted that he has no objection in granting liberty to the petitioner to approach the competent criminal court for availing appropriate remedies as provided under CrPC. The objection raised by the learned Government Advocate is noted.

In view of the submissions made above, the present writ petition is dismissed as being withdrawn with liberty to the petitioner to approach the competent criminal court for availing appropriate remedies as provided under the CrPC.
